Bush bailed, no charges
(CNS): Updated — While the RCIPS has emphasised that investigations involving the Cayman Islands premier remain active, a spokesperson said that McKeeva Bush has been released on police bail following a number of interviews with Financial Crimes Unit officers today and yesterday. Police said Bush has been placed on police bail until early February 2013 to allow further investigations to take place both here in Cayman and abroad, in connection with the allegations made against him. They also confirm that a considerable amount of property, including computer equipment, was seized during searches yesterday. "The investigations involving Mr Bush are still very active and the RCIPS will be pursuing all lines of enquiry in consultation with the Legal Department," the RCIPS said.
Meanwhile, Suresh Prasad, who had been questioned by the RCIPS in connection with allegations of corruption relating to the dynamite probe, was also released Wednesday on police bail until February next year while enquiries continue.
Police did not state what, if any, bail conditions had been placed on either the premier or Prasad at the time of their release from custody.
Despite, his release sometime on Wednesday afternoon and the news that the premier will face no more questions from the police until next year, there was no comment from him, the government in general or the UDP on his position. Cabinet, which was cancelled on Tuesday to allow the UDP party to meet, was convened today in the absence of the premier.

People should shut up especially when they don't know the procedure that the Police follow, first investigation following a complaint, if there is merit to proceed, the accused is invited or arrested and red his rights, transported to the station, booked in and then Interviewed, bailed then further investigation if necessary followed by preparation of case file, file submitted to legal for ruling, if legal determines there is a case charges are prepared, after court sign off on charges, the accused is informed cautioned and bailed to court.
I wonder why RCIPS could not have exercised simple search warrants and the simply asked him to come in to answer some questions.
Who says he was not asked to come in and answer some questions? My understanding is that he refused and that is why the arrest was necessary.

Please ensure that you put measures in place, make sound and intelligent decisions when functioning in the capacity of leaders of your country. When you hear of the arrest, one will think that something positive would come of this and that the outcome will be a set of charges, But NO! you have not even completed your investigation. 10 million in my opinion is money well spent as it has cost us far more than that by having him in power in the first place!

I fail to understand how he is on bail if he has not been charged. anywhere else in the world they can hold you for 24 hours for questioning after that they charge you or you walk free. what bail? this all seems ridiculous, a big fuss for nothing… now we wait till feb 2013

He is the PREMIER of this country you don’t arrest a PREMIER of a country then fish for charges. These ” investigations” have been ongoing for TWO+ years now this is absolutely pathetic and will quickly turn into another Tempura given the UK’s track record.
Who says they are "fishing" for charges? An arrest requires reasonable suspicion that you have committed an arrestable offence. The police can make that determination on their own.Whether there is sufficient evidence to charge is a matter which must be determined by the DPP after reviewing all of the evidence. That may take some time.
So god protects those that steal and abuse their position of power? nice.

I am confused as to what transpired on Tuesday; and I say that to say this, as someone who has had dealings with the Financial Crime Unit and was not treated in the manner in which the Premier was treated. Speaking of my situation; I knew there was an investigation ongoing and I was expecting to hear from the FCU sometime. As expected when the FCU was ready to interview me, I was contacted and advised to come down to the FCU and that I may take my attorney if I wanted. I was questioned and like Mr. Bush released without charges and advised to returned at a later date. I was not bailed, as i was not arrested on "suspicion" of an offence, which i understand to be the normal. When I returned I was advised that they are still investigating based on new information I provided and they will contact me when they have concluded.
I was never arrested for questioning, I was never "bailed" to return. It is my understanding that if the FCU had sufficient evidence to charge me, they would arrestted me on "suspicion" then I would need bail. From what I am reading, it appears that Mr. Bush has not be charged; neither on suspicion or confession; therefore I cannot understand why he needed to be bailed or even why he was arrested to be questioned; I am begining to feel that the RCIP may have muddled this investigation and Judge Henderson situation is repeating itself.

I apologize for my harshness, but I must be very frank and by no means direct this solely at you. I will firstly state I am not a Christian. Not for the fact I do not believe that there is a power greater than us, as I can not prove or disprove this. I merely could not insult the teachings of a Holy book by claiming to be a follower by picking and choosing what works for me. I will say that I was raised by a family that made sure I learnt my scripture and have absolute respect for the texts, so please allow me.
Firstly, Deuteronomy evolved around an ancient code that was comprised of a number of mitzvot to the Israelites. It sanctioned slavery, ordered the absolute annihilation of the people (who had been called the most ancient of people and had lived in the Promised Land), the legitimization of the murder of non-virgins, the exclusion of bastard children from the presence of the house of the Lord, death for disobedience, the order that the only peace offering to be made to non-Israelites to be slavery, and other outlandish laws. How you could possibly prescribe a verse from a book that, firstly, does not even sanctify YOUR right to freedom and life and bestows a blessing reserved for tha group who believed they had the God given right to do such things is bewildering, as well as ironic.
Everyone is praying in one way or the other, and just because some can scream Yahweh's name louder than everyone else doesn't mean that 'He' isn't hearing theirs- if he's hearing them at all. I know I am praying for justice. Justice not to benefit my wants, or my desires, but what is only fair and deserved in this situation. And like all prayers, this may be answered or not. Direct your prayers to the Island not to one man for self-gratifying reasons. Just saying.
It amazes me how misunderstood this man is. So please allow me to clue you in. The ONLY things that will make this man step down are any of the following, jail, severe illness, or death. Worse, if the police are wrong, or are right but botch this up, there will be hell to pay. To take this onestep further, the non-action from this man's cronies clearly states they are more attached to the man and his ways than that of the Cayman people and country. What we have here is the horrific combination of power, greed, entitlement and lack of accountability. This is a recipe for disaster and time is not a friend.
I wonder if this is an attempt to seal his travel expenses from the public. If the police declare it as evidence would it still be available under the FOI or could a judge then seal the evidence and keep it under wraps…just wondering.

Five Englishmen recently came and joined the RCIPS Financial Crime Unit and are conducting this investigation involving the Hon Premier. One has to wonder, will this be another "TEMPURA" and will it cost us another $10 Million CI and still counting.

Democracy at work is a good thing to observe. If the Premier has done no wrong and his "hands are clean and heart is pure" then I hope that his name will be cleared and his reputation restored, however, if it is found that he hascommitted wrong doing then I hope that the RCIPS will uncover every action, including that of any associates who may also have been involved, and that the full extent of the law will be unleashed. These Islands are too precious and many good people have worked too hard to build a country based on honesty and integrity to allow its undoing by contrary behaviour. I pray for all involved and trust that the truth will be uncovered and exposed.

It's obvious the popo don't have enought to charge him. Rather than cause such an uproar in the country they should have waited until they had a case if there is one.

The Police had to arrest him before he is charged. They had to get in his house so they could gather further evidence and and arrest had to be made to caution him of what their investigation and found and what further actions could be taken. (that is the process) They have gathered enough surface evidence to do this.
They have got what they wanted and will go backto his house if they need more edvidence arresst others if they see fit to help with their investigations.
Once they have gathered their information/evidence then it goes to legal who then will review the evidence collected and statements taken to see if there is sufficient evidence to stand in court for his crimes. Then the police can charge him.
Rememer now there was already some sort of charge made already and a fine imposed in 1 of the parties in the explosives case.
The gentlemen must have been feeling lucky to see that they got of so lightly with that case and thought it ended there to their surprise that was only the cake being mixed the baking and icing is coming now.
We should not rejoice over someones dimise but we hope that lessons are learnt by the parties involved and others that are practicing the same way.

Sounds like a fishing expedition to me..Two months on bail. Why would you arrest someone and tell them to go about theri business for two months until they build their case against you, then maybe, just maybe they will charge you with a crime.
Sounds like anotherRCiP investigation gone awry. No wonder the Police commissioner is so pissed off these days.
What a let down….hope the ongoing investigations don't slow down. If the legal department is reluctant to assist in a timely manner….let's bring in a team of lawyers from the UK…it will be money well spent.

That seems irresponsible. Three months of uncertainty that this country has to go through. He is the premier of God’s sake! He is not above the law but should you have arrested him if you were not going to be in a position to charge him promptly with something? Do you think anyone will buy property in the next three months while they do not know what is happening? Will anyone move here? Will anyone hire? Will anyone start a new business? This is madness. We can survive allegations of corruption if we deal with them promptly and effectively. If we throw the prospect of top level corruption into the international media and then do nothing public for months, you will have caused incredible and unnecessary harm to our economy.
The UDP can solve this by forcing him to resign/removing him as premier.

Now that it has reached this far, he aught to step down, whether by choice or not. Mr. Governor, new elections are in order. Alden, this time around, please amend the constitution and put the proper checks and balances in place that should have been there from the get go. And enhance that anti-corruption law with some rather significant penalties and jail time so that anyone who abuses power or engages in corruption will be stung fast and stung hard. The standards in Public Office must also be given attention.
Please tell me that after this very overt action of questioning the integrity of Mac that he will step down until the outcome of the investigations has be reached? To continue in the position of Premier whilst under investigation does not show a belief of innocence as he thinks but a "bloody mindedness" and sense of disregard for this country.
