Dart battle continues

(CNS): Despite recent indications by Premier Alden McLaughlin that the Dart negotiations over the provisions and concessions the developer was given under the controversial NRA Agreement were heading in the right direction, he made it clear Wednesday it was a tough and on-going battle. During a debate on amendments to the planning law, which stirred up trouble between the premier and his former colleague, Arden McLean, in the Legislative Assembly, the country’s leader said the legislative changes had nothing to do with more favours for that developer. Government was continuing to renegotiate the “difficult and troublesome elements” of the deal, he said.

The agreement withDart, the islands’ dominant investor, landowner and developer, which was signed by former premier McKeeva Bush in December 2011, has stirred up controversy since it was first announced, from the closure of the West Bay Road to the 50% concessions on all room tax from hotels that Dart will build now and in the future.

In the LA yesterday a further row erupted during the debate over the planning law amendment bill.

The member for East End accused government of making changes to facilitate big developers and continue what the UDP had started with the Dart deal, which he said was a sell-out for the country. McLean had suggested it was no coincidence that, as Dart confirmed plans to build yet another hotel on Seven Mile Beach, the planning law changes were being made that would facilitate him and other big developers but would penalise the small local landowner.

McLaughlin, however, hit back at McLean and accused him of falsely impugning his former colleagues with whom he once “broke bread” and questioning their integrity. The premier said the comments were “scandalous” and he should have tempered his contribution so as to be “more befitting of a veteran member and a friend and colleague” of the members who sit on the government bench.

The premier said it was no secret that they had been dissatisfied with certain elements of the NRA agreement and noted that the government was still trying to re-negotiate the amendments to that. The proposed planning law changes had nothing to do with the Dart agreements, he stated.

McLaughlin insisted that the legislative amendments were put forward by the technical team at the planning department and were described as necessary improvements to the process to make the law more viable and better able to attract positive development.

He said that all governments give concessions to developers in order to encourage them to build and construction was particularly important to Caymanians because that was where the jobs for local people were created. 

“I can assure the public that the only motivation of the bill is to improve the development and planning process, to get good solid development started and provide jobs,” the premier stated as he defended his Cabinet colleague, Kurt Tibbetts, who brought the amendments yesterday. “It is not about the big developer versus the little person; it is to ensure that everyone has an opportunity to get a job and get ahead and get Cayman back to where we were before the bottom fell out of the financial market.”

Negotiations over the deal, which many believed was weighed heavily in favour of the developer, were underway almost from the beginning. An independent report raised questions about the value for money and amendments to the deal were agreed. But talks broke down about the details of the amendments and as the former interim government attempted to claw back some benefits for the Caymanian people ahead of the general elections in 2013.

Dart then pulled all the previously agreed amendments and reverted back to the original deal.

However, only half of the West Bay Road that Dart wanted to adapt to turn his land into beach front property has been closed and handed over to the developer. At this point government continues to talk with Dart, who is pressing ahead with a new hotel and condo development on the site of the former Courtyard Marriott. Despite indications that things were improving, there is no new deal yet and at present Dart will, among many other concessions, receive a fifty per cent rebate on the accommodation tax for all of his new hotels, and condos.

    So basically asking the Caymanian Government to keep their word is like putting a cat in a glass of water.  All honest people should take note and plan accourdingly. Remember the code: Take all you can and give nothing back.  This is what you can expect if you have to do any "dealings" with the representatives of the Caymanian people.  Dart knows.  Thats why he has to hire Lawyers.

BRO you get nothing free in this world today ,  get a real job and stop takeing those little free handout  and use your braine like Dart is doing . You and many more are been used !

    Cayman dropped the ball in the late 80s early 90s and entirely missed the goal post in 2003. Gone are the good ole days never to return, Pandora's box was opened in 2003 and we have been living with the consequences ever since.  Unfortunately for many this is just the begining… I remember too when Argentina was awashed in cash and living the good life just like Cayman.

    King Dart owns you people. Without him this place would be a swamp land. He needs the tax free status for his hundreds of millions, you need his investments. Let the man have his fun with his toys and develop the island, or God forbid you'll end up like your neighbors to the East, and we all know how much you hate them right? 

    Let Dart build the peir too while your at it, and a new prison,  maybe the airport aswell go for it all, if hes going to  spend, let him do it, no one else will, let him buyout as much land as he wants to develop, bring in a new utlities company, have some competition, capitalism works people, don't get left behind.  Once all the white collar expats leave and get fed up of the beach then what? Theres plenty  of other islands with more to offer than this small flat rock, with crack heads running around just behind the tourist areas. All you have really is the beach, no one cares about Cayman culture, most of the locals act like their shit don't stink, the world is smelling it now.  Toursits get more bang for their buck elsewhere without all the stupid rules and restrictions like Sunday trading, or everywhere closes at 12 am on Saturday night. Wake up and smell the feces Cayman, its all yours, Darts just trying to Cover it up.

Bottom line is Dart wants to invest a large amount of $$$$ on this island for whatever reason, no oneknows his end game, he’s built up the place to beautify it, he’s continued to show his interest in investing in projects and all you people do is complain and nag. Just get over it he’s going to do what he wants, and you can’t stop him, just let him buy up all that swamp land and make his dreams come true, just keep seven mile beach and the botanic park for yourselves.

    Personally I do not like Camana Bay and only go there when I have to. BUT it is the closest thing to a viable 'town-centre' Grand Cayman has.                                                                        George Town has been taken over by jewellery and other tourist-related shops; there is nothing there for the local person.  It's not been the same since Co-mart, By-rite and Kirk supermarket closed their doors.     This is the sort of thing a planning department is supposed to control instead of imposing unecessary bureaucratic obstacles on the ordinary person.

    All the government needs to do is lower the room tax  to 2 % and create a new tax  ie resort tax of 9 % . That way Dart  will get 1% ( 50% of room tax) and government will get 10 %  ( 50% room tax + resort tax) The Government has the power to bring in new taxes and  adjust the rate of existing taxes. The contract will still be honored and the country will not lose out. The tourists will obviously have to pay a bit more but it will be no different to Florida where I have personally paid 13 % taxes on a hotel room.

    Well CNS missed the important news in this debate, Ezzard the terrible got the provisions where regulations has to be approved bythe Legislative Assembly that was removed by Mac and his UDP Government in 2012 and whic Alden and the PPM were now happpy to use for their investors put back in the law.

    The changes that PPM wanted to do in secret in Cabinet must now be done in public like allow their investors in the BeachBay hotel to build 10 stories without consulting the people in the area.

      You stil don't have to be consulted as, aparently, they took out the 'polling' section of the Law where they have to notify andjoining landowners of development. The registered mail income just fell through the floor.

    Is Cayman is dead in the water? ….. for the past 25 years whilst other countries are embraced investment and improved their tourism products and diversified their economies Cayman has stayed mired in the Land Crab Mentality and closed mindedness. Look around take out what Dart and Brian Butler have done and there is very little else.

    In twenty years Dubai has sprung up, China has become a global leader and Cayman has stayed pretty much stuck in the 1970's.

    It's about time we look at how Cayman should be managed as a product, as a well managed business and start to put us back on track to better prosperity for all our citzens. If not, Cayman will like the old mining towns in the mid-west just a speck of their former selves.

    Its a real pity. We had so many opportunites and we let them slip through our fingers. We need MORE Darts and MORE Brian Butler's becasue without them what else do we have?

        What is a "Born Caymanian"? When a Candaian or U.S. citizen living in Cayman has a child, born in George Town hospital then surely that is a 'Born Caymanian' coz they are born here – in Cayman? But many say that is not so, that a 'Born Caymanian' is someone who's parents and grand parents were born in Cayman. But I ask the quesiton coz many early Caymanians were not from here, they were from Jamicia, Great Britian and other places. So why do we have to still differentiate between 'Born Caymanians' and NON-Born Caymanians' aren't we all just people living in Cayman. One and the same? Or is it that we want to promote racial dividness so that we can alienate people based where they were born. Appartheid under was the same. Does it REALLY matter if your parents were born here or not? Does it make you a better person or not? Or it is just a way of sticking it to the man/women who has come here to live peacefully and in harmony?

          Ummm…no. You are a born Caymanian if you are a Caymanian at birth. However, merely being born in Cayman to expat parents does not make one a Caymanian at all, let alone a born Caymanian.

          You have painted a one-sided picture where Caymanians are the villains. Those distinctions are made all the time by expats who wish to denigrate Caymanians – by which they mean generational Caymanians.  The truth is that many status holders do not wish to identify as Caymanians but rather as citizens of their respective countries of origin – except of course when there is a benefit to be gained.

But then why don't Canadian's say I should get a job becuase I'm a natural born Canadian or Brits say I need government welfare becuase I am a natural born Brit?           In most countries they came from other countries.  Just because Cayman is younger than other countries doesn't make it change.  The first people that came here from Jamaica, Honduras and Great Britain integrated.  The people that come here now just hang out with their own country people.  That's the difference.  They choose to divide themselves.

          It seems you are missing the point that these were "early Caymanians" and not generational Caymanians. I've made the point before on here that the same could be said for any nation including the UK which has no indigenous population but clearly distingishes between recent immigrants on the one hand, and the Celts and Anglo-Saxons who have been there for centuries, on the other.

            I hear what you are saying but surely someone from the UK would say they are British and someone from the USA would say they are American. They could be from somewhere else, their parents could be immigrats but becuse they are living in the country and have residency then they become British, American, Canadian, German etc.

            I think the problem is when someone uses the term "Born Caymanian" as if it is a privilage pass or VIP card or something. They are Caymanian, plain and simple. We all have a rich history of generational influences and I would hope that makes us all better able to get along together.

            I for one am proud to be Caymanian and yes, my parents were born elsewhere.

        Brian Butler was the developer that dealt directly with the local builders and contractors, not like the type of pirates Dart is letting handle his opperations. He developed half of the 7 mile beach. All Caymanians made good money. Steel fixers were paid 40 cents per lb. today the crooks are paying 19 cents….30 years later.

        There were no back hand or pay off for jobs, no pay off to get all the work. No one company got all the work.

        Now check  out the Kimpton Hotel and Condo, Millions of dollars worth of work going to one steel fixer, who has all the reinforcement jobs, not only the Kimpton two sites.

        He also has the 4 story bld. across from the central police station. A multi millon dollar home in the south sound area. Like sparrow song says.."big money does run behind it!!

        Some supervisor and manager are getting extremely rich by these deals they pull off with the one -man- gets- all syndrome.

        It was never like this in the 80s and mid 90s. ever since the Ritz came in and brought these XXXX, which has ruined the industry.

        Who is Mr  Brian Buttler , he was a developer in the 70s and 80s , he was a gentleman of a      developer , not like todays developer  . Brian built his house in Cayman and lived in it mingled with the regular person , made sure caymanians were hired to do his jobs .  Can you say this about todays developer ?

    Dart owns this ppm govt just like he owned the last ones. There are many forms of corruption besides taking ca$h check the Anti-corruption laws for definitions.

    The amendments they arguing about benefit a select few developers and guess who is doing all the development at present? It's sad that they think we are so blind or cannot see that this ppm are doing precisely what the last band of pirates did in order to stimulate the economy

      Lets show more concern for the unfortunate businesses, the owners   that are bitting their nails and pulling out their hair wondering where the next dollar is coming from.

    The many beautiful District Parks that DART built, equipped, and donated to the people of the Cayman Islands, at great expense, to improve quality of life, and provide a safe value-based place for families to meet, were not maintained through time and are wasting away under the neglectful hand of the CIG.  Every gift seems to be squandered with thanklessness and deriliction, while seemingly billing the public millions for maintanence that isn't happening.  It is a God-send to Cayman that this organization is still in the room at all.  If the anti-corruption watchdogs want something to investigate – start with the maintenance budgets for these district parks and follow the money.

    That is the trouble of having a poor hand – you take what is available.  Rather than always attempt to impugn the agreement reached with Dart we should move ahead and look at the issues factually and accurately.

    For example, one receives a rebate after one pays a price.  To put it perfectly clearly-a rebate of $2.50 on a $5 box of milk means you hand the cashier $5 for your milk and then follow up the procedure to receive the $2.50 rebate.

    On the other hand the store may offer a 50% discount on the same box of milk that costs $5.00.  At the cashier you pay $2.50 for the discounted milk.

    I doubt CIG is paying any accomodation tax back to Dart.  They have allowed his hotels to pay a discounted amount of tax.

    One must look at the whole picture – what has he done to obtain, among other things, discounted tax? Invested a massive amount of capital (and keep in mind he paid for the roads which are not his); provided employment for a large number of people and a viatl part of the contractor related businesses economy.  Simply put, his developments have kept the economy ticking over at a time when one might as well have thrown the defibrillator out the door as Cayman has almost "flat-lined".

    Also keep in mind that Dart is the only player actually doing something to move Cayman's stay-over tourism prodect ahead.  Everyone else is, like CIG, so busy talking bull they can no longer hear 'emselves think

      13:14 are you for real? the person that have gained the most benefits from Dart's development is Dart himself and his conglomerate. I am positive that if the majority of Caymanians knew back then what they know now they would tell Mr. Dart, thank you but no thanks.

      it's not fact to state that Dart developments have kept the economy ticking over, you dont know that…nor do I……indeed, there is equal reason to believe that quite the opposite is true…..it could easily be argued that dart buying up local businesses (isl co's/cay distr/etc) and financially supporting them as they fail has not helped the local economy, instead it could be argued that the economy has suffered due to dart falsely supporting loss-mkaing operations to the detriment of other non-dart owned businesses that have since failed due in no small part to the competition (bank-rolled by dart)…..and i am sure many landlords around the island would argue that the massive increase in commercial office space dart has built and leased out has not really brought in all that much new business, but instead relocated existing businesses from their buildings…which now stand empty…..etc, etc……granted, if i had $1BN i could build a little compound and make it lovely too…and operate a load of buinesses that can't afford the rent in there, but could have elsewhere……alas, i'm not worth $1 never mind a $1BN!

      flip side is – life sucks, get over it…..dart doesnt care what we say or think, he doesnt have to and the country was sold years ago…..at least the compound is pretty……..

    Well the primer is only trying to fix what is broken, the deal was already signed so all he can reasonably do is get the best of what is being offered.  The previous Premier gave all the concessions and exchange/swap of land.  Don't blame premier McLaughlin on this one, he is blameless this time around.

          Firstly, the only person around in 1503 was Columbus. History is evident with the lack of interest and concern shown by him, the crew and the ship's cat,  He gave not one care for these islands.

          Secondly, any country that backs or acts as guarantor for any other country where the minister of finance spends more in a casino in one day than an average constituent earns in one year, would be glad of losing the financial risk. If I was the FCO, I would want to off load these islands in a heartbeat.

          Throw in losing a billion dollars getting "lost" over again then your complacency is worrying.

          Islands were not even inhabited until 1658, and were a dependency of Jamaica until 1962.  So who do you mean exactly?

            Cayman did not legally become a dependency of Jamaica until 1863, and don't get fooled by the term "dependency". 'Founded Upon the Seas' says the Jamaican attitude to Cayman was one of "benign neglect". So the poster means Caymanians depended upon themselves.

    The amount of taxation that is levied on tourists visiting Cayman has long been a point of contention for me. They get higher and higher without any of the powers that be realizing that does major damage for hotels, shops, restaurants, car rental agencies etc. and that trickle down is felt across the economy. Regardless of the spin coming out of the DoT, all one has to do is look around and know things are not right.

    Now, these same taxes are paid in every jurisdiction in the Caribbean. Each island has it's own form and, annoyingly but honestly, the taxes levied on tourists are pretty much the same rate. 

    I like Camana Bay. I like the way Dart makes things LOOK. 

    Or should I say I like the way his people make things LOOK.

    Anyway, to the point at hand: If someone is allowed an inch, they will take a mile. This is a perfect case in point.

    Dart needs to be stopped NOW. No concessions should be given to him that would not be given to any other entrepreneur on island. NONE. If he doesn't like it, he can pack up his machinery and move on to another place that will let him RUN ROUGHSHOD OVER SOMEBODY ELSE.

    Stop him NOW!

    The article seems to say the bottom falling out of the financial market caused our current problem.  I disagree.  The cause was (is)  the waste-and-spend tactics of some of our leaders, not to mention graft and theft, etc.

    Lets see……..the Island Resorts, Barefoot Beach in East End, the Waterford in Safehaven, the refurbishment of the Hyatt, the refurbishment of the old Marriott Courtyard (closed in 08 for 'Paloma repairs…), Beach Bay resort, Ironwood (yeah right….)…….etc, etc, etc….. 

    (with apologies to Shetty of course, as he too followed through with plans no one believed).

    I wonder what our Governments stand is going to be on Darts desire to build "over" West Bay Road and the by-pass in the Camana Bay area.  In essence giving us two tunnels, one with the new Hotel or grounds on top it.  I know that Darts Modus operandi is to keep this type of  plan out of the public realm or deny it until they can find a way to get it approved behind the peoples back., as then did with the north end road closure.  The onlly wat to West Bay from town would now be through a tunnel.  How Cayman is that.

    Theirs is a great military plan.  Flanking Seven Mile Beach on the north and south with their hotels.  A classic military tactic for total take over.  It has been used for centuries.

     I have been in many deals with locals and it makes me sick how they think they can extort  anyone whome they can, even there own.

        Yes cayman would crash and burn if dart shut down his fairyland. Since you dont recall i will remind you that b4 dart caymana bay land was swamp and his home was out of business and rundown. Yes by jungle standards cayman was a  fantastic story of how people went from no electricity to fiber optics in only 40 years.

        Thank goodness those that came here demanded some modern standards.

        But really look around you your island is full of slum with people that still inbreed and crap in a bucket
