WB rapist gets 12 years

(CNS): A 46-year-old West Bay man has been sentenced to 12 years imprisonment for the rape of a 14 year old girl which took place in December 2010. Tyrone Ebanks was found guilty of the offence by acting Justice Michael Mettyear on Thursday following a judge alone trial last week. Ebanks had dragged the teenage victim, who was a virgin at the time of the offence, from her bicycle as she drove past his home in West Bay. He pulled her into his house, where, despite her best effort s to fight him off and her cries for him to stop, he raped her in his bedroom. The victim knew her attacker and when she made her escape she immediately reported the rape.

After the attack Ebanks had threatened the young girl with a knife and told her not to tell anyone. However, the judge noted the girl had bravely disregarded his threats, telling her family and going to the police at the earliest opportunity.

Although Ebanks denied the offence, saying that the girl had come into his house while passing on her bike to use the bathroom and there had never been sexual contact, DNA recovered from the rape kit taken from the teen victim was a match for Ebanks. The judge said there was overwhelming evidence that sex had taken place and the young victim had described her ordeal in a clear and measured way.

The court heard how the young victim, who is still only sixteen, had been impacted by her ordeal. In a statement she said she continued to have nightmares and believed her life had been widely affected by the attack.

The judge said that the crime of rape was one of the worst things that could happen to a woman and was even worse for such a young girl. “The sympathy of the court goes out to her and we can only hope that the conclusion of this trial will bring closure for her and allow her to start the healing process,” Justice Mettyear said before he handed down the twelve year sentence to Ebanks, which was at the top end of the chief justice’s guidelines.

The judge pointed to a number of aggravating factors in the case, including the use of the knife to threaten the girl after the attack. Ebanks also had a criminal record and had been on early release from a prison sentence for armed robbery at the time he committed the offence. Justice Mettyear noted that Ebanks, who had denied the crime and who had accused the victim of lying when it was he who had lied all along, had shown no remorse.

Despite her attempts to get away and her pleas for him to stop, Ebanks had still raped his young victim, the judge said.

Throughout the verdict and the judge’s sentencing Ebanks appeared to remain calm as he stood in the dock but after the sentence was handed down and he was taken into custody, he shouted angrily at the judge and the prosecutor as he insisted he had been set up.

    This is not only rape!  This is also consider child molestation!  He is a child predator and should be locked up for the rest of his life.  When is the Cayman Islands Government ever going to realise, that they really need to get a child molestation and sex predator registration list going, so the public can be aware of these sick monsters.  These molesters should all have to register their names, and whereabouts, so they can be track down anywhere they go, once they let these monsters back into our society.  Something serious has to be done and the time is now.  May God bless our children and may he always protect them from any harm.

    Many years ago I stood in for the mother of a teenage rape survivor during Police questioning.   To me her case was doomed from the beginning for a variety of reasons. One the young males she identified was employed by a very large international company and had family with the right connections etc.  She identifed both of the rapists.  The case never even saw the inside of a court room.  Although the girl was a Caymanian, she left the island. I doubt she will ever return again as she and many like her see Cayman as a backwards place where women are not respected and have very little in the way of human rights.

    However the marl road says at least one of these young males reoffended.   I often wonder how many rapes could have been avoided if everyone did their job a little better, including the parents of the young males in question.  Yes, your child can be a rapist.

    While I'm sorry to hear of the ordeal this young lady has had to face, but I'm proud of her for having the strength to come forward.  I'm happy he is behind bars for 12 years.  I only hope he is not released from jail before those 12 yearsare up.

    Having said that, I think it is still difficult in Cayman to obtain a conviction or a trial when the offender comes from a "good family" and has a "good job".  We have much to imporve in this area.

    Mr. Ebanks has a long list of issues.  Whatever is wrong with him or has happend to him does NOT give him the right to do what evidence proves he did.  I'm happy he got 12 years and wish it could be longer with many long hours in the heat popping cliff rock to keep his mind and body too busy to daydream about destroying the lives of others.

    This is a horrible event that the young lady will never forget.  She and those who truly love and care for her will have to deal for the rest of their lives.  The hurt and fear does not just vanish becase he is in jail nor will it end when his 12 years are over.

    I hope she will find a good mentor to help her through this event and show her it is possible to go on and be a productive member of society who can in turn help others. The memory will resurface at different times in her life, but with help, she can learn to deal with it in a constructive way.

    I like many here know who this creep is but there are many who do not. Why are pictures of convicted criminals not published in the media for all in the community to be aware? I don't get!!

    If it is due to a law then we need our politicians to get off their worthless butts and change the law to allow publication and also enact a 3 strikes and you are out law. Obviously 12 years being the top end  sentence for this type of crime is a joke.

    I have a teenage daughter and had this been my daughter, it would be me going to Northward and not for 12 years but for life for the slaugher of this beast.

    THey always say that suspects and accusers was always a victim themselves, its a possibility that he was Sexually assaulted when he was young. Do we have any evidence in that? Sometimes we need to did deeper into these crimes rather than quickly judge someone. We need to make sure that ALL VICTIMS receive PROFESSIONAL help in order for  these acts to STOP repeating!!! Brave of the 14 yr old to seek help immediately. Such a shame for only getting 12yrs.

    12 years? ONLY TWELVE YEARS??!! As the father of three daughters I am absolutely sickened by this! A zero should have been added to that number! And castaration should have been mandatory – with a dull machette but without anesthesia!

    The judge's hands were tied by our stupid, antiquated legislation. Our MLAs need to do something worthwhile for a change and remove any and all limits on sentencing for the crime of rape.

    As a mother of a child who was raped almost the same way when she was 18 (in US), I can tell you that this girl or any victim of a sexual crime has a very difficult life ahead of her. Psychological trauma leaves its grip on every cell of her body in a form of psychological and physical illness.  My heart goes out to her.

    I have known Tyrone since I was very young and he has always been a very scary young man in many ways.  He is a repeat criminal going from breaking into peoples homes and cars and stealing from people on the beach to assault and rape of a precious young girl.  Whenever Tyrone was locked up the breakins stopped.  As soon as he was released they started again.  Instead of the dimwits we have in Govt. wanting to start a rehab program they need to make the laws strong enough such that the penalties for even the mosty petty crimes may serve as some sort of deterrent.  If the person thinking of committing a crime is halfway intelligent and civilised he/she will consider their fate before they act.  Otherwise they should be locked away for life so they cannot do things such as what Tyrone did to this young woman.  Thankfully she was raised to do the right thing no matter whose toes she stepped on by reporting him and thankfully this judge gave him the highest sentence permitted but that is still not good enough.  With stiffer penalties and a system where he would have still been incarcerated for previous crimes this would not have happened.  We should become a world leader in the puynishments we inflict on our dregs of society, not follow the rest of the world by focus on the human rights for such scum.  They give up their human rights when they commit heinous and inhumane crimes.  PERIOD.

      You are so right with many of your points. I've known Tyrone in West Bay a very long time now and he has always made me watch him very closely whenever he was around, because you knew from his own revelations of his past or his present intentions, or maybe from reputation that someone warn you of. But he was so devious as well as cunniving with his sick/evil self, (that some times he was this nice smiling friendly person and at other times he would be  threatening violence or verbal abuse) whether he was either drunk and/or "high" or he wanted a "fix", he would absolutely scare you, fearing you could be his next victim. There were numerous crimes that he has committed that should've kept him locked away for a long time and perhaps if they were handed down to him this young girl would've probably not had suffered this sickening crime(to her and us). "Human rights" of the "criminal"? What about her human rights to live her young promising life as a teenager and realize her full potential as an adult, that got striped away from her? Anyways, he never got enough time for the crime, so be on the look out for him again soon, because they can get out on good behaviour no matter the crime committed and never serve the full sentence. God bless the victim(s) and the families that suffer because of these evil ones living among us.

    Tyrone has been allowed to roam free in West Bay for way too long. This sentence represents a slap on the wrist and is way too short a time for an animal like him to be put away.  The young girl will never be able to forget this experience and neither should he! I pray that soon our legal system identifies these predators and take them out of society forever instead of allowing to return to the community and repeat their offences.

    Tyrone has been raping young girls in West Bay for year now.  I remember when he cut a 15 year old throat by Tony Powells Fish shop and not too long ago because she would not go home with him.  I saw her a few months ago and she has this horrible horrible scar right around her neck.

    Mr. Ebanks is a repeat sexual offender, a "known rapist" according to the RCIP, a routine sexual predator and has no place in civilized society.  I cringe at the fact that this man was even out of jail to allow this rape to happen.  Mr. Ebanks is the same person that assaulted a female friend of mine a few years back and thought he was still serving time for that offense, but I guess not.  Our legal system does very little to protect woman's rights – this does not excuse Mr. Ebanks for his actions – but it was our very own legal system that has provided this "known rapist" every opportunity to act out his brutal desires.  I am disgusted by this man and equally disgusted with the handling of this man by our sexist and shamefully dated legal system.

    Ive known Tyrone since i was a young man. Hes scary, strong, lacks any sort of reasoning and is a habitual criminal. This man is not fit to ever walk among the public. As long as you allow him to return to the street he will commit a crime. 12 years? he might do 7 or 8 and hes back again. This deserved a life sentence!! How many strikes can you get?

    He would have certainly received a much longer, more punishing sentence had he raped a man in the same circumstances.  All other facts being the same, the Caymankind of homophobia would've resulted in a much greater sentence had this been a male rape.  Regardless, what's done is done.  Ebanks gets a light, virtually meaningless sentence and there's nothing that can be done now.

    Also, I'd like the person or people who are giving the "thumbs down" to the comments on this board to reveal themselves.  Speak up and defend Ebanks and his joke of a sentence.

    Well I hope while in prison, someone will likewise do to him.  A 12 years sentence only equates to the girls age.  He should had gotten life for that. That precious girl has been sentence for life without parole and he ONLY gets 12 years? with an option of parole…amazing! Then what? when he gets out he will again do it and terrorize the neighbourhood and district again, as everyone in WB knows him. He should never had been let out, knowing his reputation. That is a big failure to our society. That loophold needs to be fixed by the lawmakers.

    When will we have the RIGHT to know such people are released from prison, placed back into our communities without us being told and which Board of Psychiatrics evalutate him before his release???? 

     

    If my memory serves me right, this man was previously imprisoned for the same kind of crime.

     

    Our entire govt continues to be an embarrassment to our society, collectively with most law makers- doing nothing besides filling their pockets with easy pay and doing next to nothing for our people.  We certainly are short of good thinkers in this bunch 'oh, I didnt think of that".

    Twelve years is not enough, he should have received 20 to 25 years or more, as this is very serious stuff.

    For the powers that be, please have this law amended to allow a longer sentence, as this is another disrepect to women!

    Well Hallelujah!  It took this visiting Justice to hand down a good long sentence for this perpetrator.  So often rapists and defilers are getting such short terms.  Thank you Sir.
