Smokers reminded to stub out in public

| 11/10/2012

smokefree.jpg(CNS): Government officials issued a reminder this week to smokers that smoking is not permitted inside public places or within ten feet of public buildings. The 2008 Tobacco Law and 2010 regulations prevent people from smoking in bars and restaurants, office buildings, businesses and other enclosed areas as well as up to10 ft. from any entry, exit or other opening. The Medical Officer of Health Dr Kiran Kumar said a public place means any place, including a workplace or public conveyance to which members of the public have access whether or not a fee is charged for entry.

The Law describes an “enclosed place” as a place which has a full or partial roof with at least 50% of its sides covered with walls, windows, blinds or curtains. Anyone who smokes in a public place is liable forsummary conviction to a fine of $2000 for their first offence and up to $10,000 for the second offence.

The list of smoke free places includes all offices, office buildings, warehouses and places of work, common areas in apartment buildings, condominiums and retirement homes, health care facilities and their grounds, educational facilities and their grounds, gyms, parks (including marine parks) and sport stadiums, beauty parlours, barber shops and Laundromats, enclosed bars, and restaurants, any means of transport (including boats) used for commercial, public or professional purposes and used by more than one person, all government owned facilities, public toilets and public transportation terminals (e.g. the cruise terminals), all shops and shopping centres, concert and convention halls, pool halls and shopping centres.

Dr Kumar also reminded merchants that cigarettes can only be sold in full packages as prepared by the manufacturers. Hence, it is illegal to sell single cigarettes.

If anyone has any doubts about the legislation, please contact the Public Health Department to avoid prosecution. Further information on the Tobacco Law 2008 and Regulations 2010 can be had by accessing ministryofhealth.gov.ky and www.hsa.ky

It would be a good idea to substantially increase the duty on all tobacco products.

The reason so many folks in Cayman today are getting cancer is because of the  cigarette smoking especially the second hand inhalation. Just wish the Government could stop the importation.

Or perhaps the poor diet, no exercise and sun might also contribute to cancer?

The topic is well-studied with medical research published for half a century or more: the action of knowing the risks today, and smoking anyway, now earns smokers the deserved rank of social pariah.  There is no redeeming value in the habit.  Broadcasting your "suicidal personality disorder" is not attractive, nor will it advance your career, nor will it continue to garner sympathy.  It will keep you in a terrible rut of chronic illness and quite likely trim your Earthly time by decades.  Thankfully plenty of quitting options now for those with the maturity to make the choice to quit.  If you or someone you care about still smokes, go to the doctor and tell them you want to get serious about quitting.

why was smoking banned in bars in the first place?

Pity they didn't implement a law whereby every stinking big truck, old crappy car etc etc is removed from the raod the help the environment. The amount of rubbish some of these vehicles spew out of them is digusting. How do they get to keep them on the roa?? They need to bring in emissions testing too for inspections then see how many stay on the road.

With regards to cigarette smoking just come to Cardinall Ave & see how many smoke in front of buildings!!

FYI cigar bars typically have a high end ventilation system, any one working within that establishment could tell you that the smoke is usually sucked out before it even has a chance to saturate in the air…fool

    • Anonymous says:

wow…thanks for that…maybe this can be installed in all workplaces, bars, restraunts…so we can all go back to smoking in public….yipeee

Much ado about nothing! As far as I'm aware, no one has been prosecuted for smoking in a prohibited area. I've yet to see a policeman with a tape measure approach a  smoker. (Heaven forbid) Then no one has been prosecuted for blue headlights, tinted number-plate covers, or black windows in their cars, even though they drive in front of police noses every day. The law has fallen into disrepute in Cayman, and it comes from the top. A good example is you story today, of how government departments flout the intentions of the FOI law. That's lack of leadership for you, as if we needed another example of how not to behave.

Did you think before you asked that question? How ignorant are you? Obviously they have to make exceptions for a cigar bar thatswhy its called a CIGAR BAR and just F.Y.I they have to pay a considerable amount of money for the license to operate these places.

No one is enforcing this but everytime I see person's within the 10 feet I point to the sign and ask them to adhere to the law!

Each time this comes up I just have to laugh. I can't wait for the day that all cars, trucks, boats etc. must be electric, or close down all the factories that produce acid rain and/or make cities and surrounding areas simply disappear due to the smoke they produce, or no more fireworks anywhere in the world, or no more aircraft allowed to fly, or no more coal/gas/diesel burning for energy. Or am I too harsh here? Too aggressive about pollution perhaps?

I am all for clean air, believe you me. So having a law that reduces world pollution by about 0.001% is a good start don't you think? We will be so much healthier, no?

I have nothing against the law, just pointing out what exactly we are doing to this world and ourselves right now. So, let's all stop the hypocrisy and start thinking about all the things we can do each and every day to clean the place up, here, there andeverywhere in any way you can and perhaps some day we will get somewhere that makes a real difference.

Dude, acid rain is like so 1990's. Get with the programme, it's all about global warming now (until the next global threat comes along).

Plus I don't think this ban is due to the pollution smoke causes to the environment. It's about forcing non-smokers to passively breathe in smoke in an enclosed environment. If we want to help combat global air pollution, all cows must go. Seriously look into the methane they produce and the impact that has on the atmosphere. It's all a conspiracy man!!!

      • Anonymous says:

True, they have shifted the topic so less people appear to worry about acid rain but that does not mean it is no longer there.

You're right about the cows as well even though that has more to do with global warming then anything else and yes, we could do without millions of them if we all become vegetarians. But I guess that is not the programma you were referring to.

Hold on……so you're telling me that if i am on my boat and i am about to enter a marine park, i need to put out my cigarette?? I hope this is a mistake otherwise its one of the most ridiculous laws i have ever heard…..and that means a lot considering some of the recent onces the government has implemented.

in california you cannot smoke in any public place…and rightly so….

  12. Anonymous says:

what about cigar bars? why different rules for them?

    • Anonymous says:

The clue is in the name Bobo!

      • Anonymous says:

the question is bobo….why are there different rules for different bars?…… can i set up a cigarette bar tomorrow?

    • Anonymous says:

Whew!! The Cigar Bar question again. A cigar bar is where you go to smoke cigars. That is why they are called cigar bars as a warning to the un-suspecting potential client. If you don’t like that then don’t work in a CIGAR BAR and don’t go to one. Unless you are the type of individual that would dive off Pedro Cliffs because the sign says “NO” then hopefully you should be able to get-your-head around this concept.

      • Anonymous says:

Except that most of the people in "cigar" bars are smoking cigarettes, not cigars!  This  means that "cigar" bars get the business of cigarette smokers as an unintended consequence of the exemption and an unfair advantage over competitors.

        • Anonymous says:

          lmao

        • Anonymous says:

LMAO!! You seriously cannot be this stupid!  I am rolling off my seat on this one.  Please save the Cyber world the space…. 🙂

    • Anonymous says:

Are you for real?  If you go to a bar to drink do you not drink at the bar?  If you go to a cigar bar do you not smoke cigars there?  It's obvious why they are exempt and its obvious non-smokers are not likely to frequent cigar bars.  I can't believe you are asking such a dumb question.

      • Anonymous says:

so workers in cigar bars don't deserve the same protection as other workers on other establishments???……who's asking the dumb questions now?

        • Anonymous says:

If there were no cigar bars then there would be no cigar bar workers – can’t you get your head around that concept? Whew!! Sure, open your cigar bar tommorow and compete with the other cigar bars. That is your democratic right but don’t expect to have a restaurant or nightclub and expect to have the same rules applied to you as these are not cigar bars where cigar smokers go to smoke, served by cigar bar workers who chose to work there.

          • Anonymous says:

wow…you have obviously have no idea regarding health and safety  requirements for employees……

its like saying health and safety is optional on construction sites….

        • Another dumb question says:

If they so offended by smoke why on earth would they apply to work at a cigar bar?

        • Anonymous says:

14:49, hey Dumbo, why would you work in a cigar bar if you dont like cigars? You would be pretty stupid to accept a job there knowing full well that you are going to be inhaling cigar smoke on a regular basis.
