Court goes easy on brawling jealous chef
(CNS): An executive chef from one of Cayman’s leading restaurants was given 120 hours community service by a judge Thursday after he broke a man’s jaw in a jealous rage during a fight at a West Bay Road gas station. Michael Fischetti, a chef at Ortanique restaurant in Camana Bay, punched Edenis Miguel Rives hard enough to knock him out and break his jaw, even though the man was trying to get away. Fischetti was convicted following a three day judge-alone trial before Justice Swift in February in connection with the fight last March, when the chef over-reacted after seeing his girlfriend embrace male friends at the gas station in greeting.
Although Fischetti was facing a possible custodial sentence, the court found in his favour because of a degree of provocation and his previous good character. In addition to the 120 hours of voluntary work the chef will now be required to undertake in the community, he was also ordered to pay his victim’s medical bills of more than $3,000.

Silly, sick sentence!
So if he’d hit his girfriend, as she tried to get away from him, what would the sentence have been? Probably 5 years in prison.
So..what’s the difference?
He still hit an INNOCENT person!
Looking over recent judgements it appears as if the courts are going too easy on the guilty…..this makes a world of problems for the innocent out here…..and it sends a very bad message to the undecided at risk youth who may just decide that crime pays since the punishment is so soft and easy.
I am tired of this "good character" crap. Breaking a jaw? Jail every time. The judges of Cayman are letting the people down by being this soft.

A broken Jaw is no easy pain to bare because of a jealous fool, that man could have died because of that idoits silliness, I hope this judgment is appealed and he is sent to Jail, no child or elderly in Cayman needs his community service, he needs to pay for his stupidiaty and for all I care deported.
Feel no way this man has issues.
I just read the news story on this from back in February and now this one. Boggles the mind as to why this guy got off with such a lenient sentence. But, tell you what, make him go up to East End and try that ….
Yea, or make him touch down with that behavior in NS.
The loser ought to be locked up – he could have killed the man. Insecure, abusive, vile little boy. How in the world did the judge come to the conclusion that there was a degree of provocation? Should he kill his girlfriend in a fit of rage would he get a slap on the wrist again because he was somehow provoked? Deport the loser!
This is terrible and he should be in jail. Period.
Obviously there are anger management issues that were left unaddressed. This guy sounds like a problem waiting to reoccur.

Macho behaviour rewarded. Hope this stands for $$$$$ in punative damages in a civil action.
I highly doubt the sentence would have been the same if he had not been an expat on a professional levl work permit.
If that had been a 'local', his a$$ would have been sent down for at least 3 months.
Not knocking or against the expatriate community…just referring to the in-equality in the system.
Because of lack of jail time in even a suspended sentence, he will probably keep his work permit as well.

deport his rass. If someone tried to apply for a work permit and had an offence like this he would be denied the permit. Therefore he needs to go.
He is probably abusive of his girlfriend too if he is that jealous, insecure, and full of rage but unfortunately she probably won't admit to it. 120 hours of Anger Management should have also been considered but I am baffled about no jail time. In any other civilised country he wouldn't be treated so kindly. I am still of the opinion that persons here on WP who are found guilty of any such offences should have their work permits denied and they be sent home. It might be a deterrant to those who consider breaking our laws and peoples jaws.
What provocation? He doesn't "own" his girlfriend. 90 days in the slammer would be appropriate.
