WB road closure official
(CNS): Updated — The government has officially gazetted the closure of the first portion of the West Bay Road in an Extraordinary Gazette published on the website Wednesday. However, the road itself remains open and the NRA said it has not yet been informed when the road will physically close as neither junction to veer traffic on to the Esterley Tibbetts Highway has yet been completed. Although it is the legal authority that governs the country’s roads, a spokesperson for the NRA told CNS that it is waiting on instructions from Dart about when the actual closure will take place as it has not yet “been informed when it will happen”. The gazette comes following a second legal action being filed in the courts in an effort to stop the road closure.
The gazette detailing the closure of the road, directs people to the Lands and Survey office or its website to examine the area, which is to be closed under the controversial deal government made with the Dart organisation. Although not there yesterday, after being contacted by CNS it has now been posted and can be viewed here.
Government ministers revealed details of the first strip to be closed at a government press briefing last month. (See picture at right)
It is understood that the closure of the road does not yet mean Dart has taken possession of the crown land but it is the first definitive step towards the closure of what will eventually be more than 4000 feet of the local road, which has been a byway of some kind connecting West Bay to George Town for more than one hundred years.
Cabinet members had already stated that the first 1000 feet or so of road was going to be closed before the PricewaterhouseCooper independent review of the ForCayman Investment Alliance, which includes the road swap between Dart and government, was made public. But it also comes during the time when ministers have said that the Cayman government is continuing to negotiate with Dart over elements of the land swap. CIG is now attempting to get the developer to also widen the original stretch of the Esterley Tibbetts Highway from the Butterfield Roundabout in George Town to Camana Bay, which is still single carriageway.
The appearance of the official gazetting of the closure, which was not announced by government today, even though the Legislative Assembly met this morning, was not unexpected but it has raised a number of questions following a second writ calling for a judicial review of the deal, which is understood to have been filed in the Grand Court Monday by another activist opposed to the closure. This comes on the heels of a legal action filed by four West Bay women who are also seeking a court decision on the legality of the closure and vesting of the land to Dart.

Congratulations, Cayman, you just got stiffed once again by the biggest rip-off artist to ever blight these islands. When in darnation are you going to stop rowing with each other and get organised against such exploitive developers? Dart is laughing his way to the bank, can't you understand that? Quit harping on about the UDP/PPM/PMS what the heck and get real for goodness sake.
None of the DART Group's local real estate investments will be moving the needle on their family fortunes anytime soon. Their break-even mark is decades and decades in the future. I look forward to the new roads, the new beach parkland and the new hotel. It will be very stimulative for the islands, and thank the Lord we have a local benefactor willing to pour Billions into quality 1st world infrastructure at a time when nations are begging for this stimulus.
DART didn't squander the country's surplus, nor did their family group bankrupt the CIG, nor did they negotiate the deal on our behalf, our politicians did that to us. Blame the CIG for cloaking this deal in secrecy and even now for failing to offer suitable explanation as to the particulars of the agreement.
I do not fault DART for presumably honouring their side of their roadway construction commitments, at record pace, even when faced with the latest moving goal posts. The full blame for the state of our national balance sheet should be apportioned to our amateur former leadership. The blame and anger should therefore be directed there, not at DART, and I would encourage all not to empower those people again with their votes in May.

First of all, uney complaining about road closure, first they no more public beach but dart is obviously putting a better public beach in place so the we can enjoy. Second, why uney hate on DART so much, but ya"ll still be giong to camana bay every weekend, who build that, MR.DART Yezz Zir. he made a place for tourist and locals to enjoy and building a better infransturcture for cayman. Imagine that, years ago, the government had built a four lane bypass to connect West Bay to George Town to avoid spoiling the natural beauty of Public Beach.
Now imagine that the big bad developer wanted to shut the bypass and build a road right through our beloved Public Beach! The horror!!! A road right through public beach!!! That beach is our birth right and a national treasure! You can't build a road there!! And think of the traffic! What happens when it floods?! What a ridiculous place to build a road!! No way, no how!! Over my dead body!!

Please someone with guts, run in Cayman Brac with Moises, we need to get Ju Ju out of the house. This has got to be the worse deal in the History of the Cayman Islands. Dart could build his hotel and put a bridge over to the beach and just simply leave our road alone. We are already driving 25mph on that road, we would had conceded for the pedestrian crossings, we could had done it together. What the Dart Group should had done was to concentrate on stopping that bottlenecking by Camana Bay and by the CIS school every morning and evening. The traffic stretches all the way back to AL Thompsons in the evenings and by the Ritz bridge in the mornings. XXXX He could had satisfied with his concessions like everyone else, but noooo he wanted the road too. Why? XXXX It will go down in history that this one man and the UDP destroyed our West Bay Road and stole our public beach. Watch and see his destructions when his yatchs controls the touris businesst, stingray city and more in the North Sound. Only a foolish man builds his wealth upon the sand.

Again, for the umpteeth time…….. there is NO proposal for Dart to fund a "waste management facility". That meme is a lie. Dart proposes to provide three open, lined pits. CIG is then supposed to fund the trucking of Trashmore to the pits. Dart will cap — but not mitigate the soil/groundwater — of Trashmore, and that's the end of his obligation. We, the people, get to pay for the increased costs of trucking our trash to BT, while apparently enjoying the idea that we've turned one dump into two, the second being in a residential area.

I have said it before and will say it again our caymanian mothers and fathers sold their land to the foreign devil many years ago, now that you have a caymanian buying the land back you all XXX. the problem I do have it that we have one person who can literally buy the entire island and most of its businesses without flickering an eye lid, he has deeper pocket than most of us can really comprehend, and it appears this is what he is doing. Mark my words in the next ten years he will employ more employees than the government In fact don't be surprised if he doesn't employ at least 50% us. Granted, some of my posts may come across as controversial, however, I am steadfastly for the welfare of my country and fellow citizens – as every one this world has the right to be.
There may be times that my sensitivity may be clouded by the aforementioned motivation, however, I must remain loyal to my beliefs. Unfortunately that stance may not tie-in with the perspectives of others but I guess that is the way of life.
E.g., When I lived in a foreign country there were many things that I did not necessarily understand or agree with. However, on many occasions, I had to empathize with their perspective and put my own on the back-burner – as a matter of respect.

The thing is, this project will be good for the island in the short term. Whether it will be beneficial in the long run will depend wholly on whether it is done properly or not. The park, children's play ground, camping ground, additional parking for partons of the establishments along WB road (such as Calico Jack's, Tiki Beach, SurfSide), bike and walking paths and the watersports and tourist activity huts will be useful and beneficial to our island if they are designed and implemented properly. The thing that most people are complaining about the possibility of increased traffic, and I agree – there probably will be increased traffic. One can only hope that the developers will implement preventative measures such as working during non-peak hours, working multiple shifts in order to minimise road closure time.
At the end of the day, this deal has now completely gone through, so as a people, lets start looking at the bright side – it will create some jobs (both short and long term through construction and eventually the staffing of kiosks along the beach), traffic flow will eventually be returned to normal, and based on the plans the park seems to be shaping up to be a beaufitul addition to our island.
So are you also happy to be paying more taxes because DarT will be collecting all of the tourist tax, keeping half then paying the remainder to government.
So how will the lost Tourst Tax that we depended on be replaced?
Wake up, some new tax will be created or some tax increased to make up for the operating income taken by Dart.
Yes, it is a steal, a Dart steal that Dart and Mac has perpetrated on us Caymanians.
You cannot lose tourism tax on a hotel that does not exist! Currently Dart does not have a hotel so we are not losing taxes on his hotel the other hotelsare funding everything. So even with the concession it still keeps where we are at minimum or ahead of the game with a partial collection on a new facility.
Except that at the moment the hotel is closed so there is zero tax. It would be nice to start looking forward instead of constantly looking back – nothing wrong with learning from mistakes made but the Cayman populus seems hell bent on reliving the past (instead of learning from it). Let's get cracking on the next few important months and make sure we have a solid stable government going forward – THAT is how we can fix things, not moaning about decisions that the previous governments (that WE ELECTED) made. The time is now. Lets fix the future.

"Democratic protest"? The democratically elected government entered into this deal. That is the way representative parliamentary democracy works. A few oddly dressed moaners have a picket means nothing. The vast majority of people want the deal to go through.

Fact – best case approx 4000 people cared enough to sign the petition (allegedly including non residents, let alone non Caymanian's – but lets just assume every one of the 4000 is an adult Caymanian). Fact – there are approximately 18000 registered voters. Fact – there are somewhere between 55000 and 60000 on the island, including expats.
Where in all that do you conclude that the majority of people oppose the road deal? The majority of even registered voters apparently don't care enough to sign. So whilst I agree not signing the petition doesnt mean you support the deal, its pretty clear that they are no much fussed. There is absolutely no way you can assert the opposite – that the majority oppose it.
If getting a considerably greater number of people, and an absolute majority of those that bothered to vote, to say yes to one man one vote is not sufficient to change the governments position, why on earth is getting less than 25% of the elctorate or less than 10% of the resident population, going to be enough to make the government change a policy decision.

Actually, I disagree.
Democracy does not necessarily take place in respect to every issue simply because representatives have been democratically elected.
Take for example the illegally waged war in Iraq on the part of the USA and the UK. Literally millions of people in those countries (and around the world) protested against that action, but to no avail – it came to pass. Producing two of the most prolific war criminals of our time in the process – GWB and Blair.
As another example we can take the issue of top-up university fees in the UK. I am quite certain that not a single MP was voted in on a campaign to introduce or increase university fees. There were mass demonstrations at the announcement of the changes, at times violently, however, yet again – with no positive results for the protestors. (Try finding a UK university with annual tuition below £7,000.00 today!)
There is no way you or I can factually claim that; "The vast majority of people want the deal to go through.".
What we are simply seeing in Cayman today is the sad arrival of what has been taking place in the "1st / western / advanced" world for a long time now – the power of big money.
That is the long and short of the matter.

Agreed, as a Caymanian business person I have just spent the last two months recruiting specifically stating that only Caymanians or right to work holders could apply, why two months because none would apply!!! Finally I got 7 to apply for ten available positions and by the way I am paying higher than the normal salaries as I figure I can apply cost of permits to wages and of those 7 only two have bothered to show up for work regularly and on time the rest showed up a day here a day there and then just stopped coming in! So now I repeat the process and sorry work permits holders will be considered this time. I wish I was a bartender or server they may make low base wage but on average they make between $30,000 to 60,000 per year and bar tending has to be a lot more fun than running a business with all of the ways government tries to put you out of business, heck I’m ready to go work for Dart!

This is a travesty of justice. The people have not been informed or listened to. Just told. Now the action is taken before the report has been made public, or the courts have had a chance to respond to the Writ that has been filed. It is clear that they (Dart and the government) want it done before transparency takes place and before the courts rule on the Writ. I ask you why is that. What do they fear.
As a West Bay voter I will not even consider any members of the previous or current UDP government (regardless of what they call them selves now) in the next election. Their total of lack or respect for openness and consultation with the people is clear. I do not think they even know what the term "due process" means. They have certainly made my choices in May much easier. (I guess I should thank them for that.)

Well said. We now know — if it wasn't previously apparent — that the collective will of the people means nothing. We also know that procedure as laid out in the FFR and properly tendered/vetted protocols are worth nothing when a few shiny trinkets are waved in the faces of the ruling class.
We will know the full terms of this "deal" when we are told, if ever. Cayman looses, Dart wins and will continue to win via concessions that we, the people, will have to make up the shortfall from.

Once the hotel is completed Dart will get concessions for a part of the income that Cayman wouldn’t get all without this deal. A piece of the pie is better than no pie at all.

XXXX the fact still remains that all the property on both sides of the road belongs to the Dart Group and they were able to purchase it because it was for sale. For your information, the road, as it is now, was not always there either. Many years before you even heard about Cayman, the original road was closed and moved quite a ways inland. If it is the view youre talking about, what would happen if the Dart Group decided to let the natural trees and bushes on their land grow without any trimming or pruning. Would there be a petition demanding they cut the trees down so drivers can take their eyes off the road while driving to look at the sea?? XXXX
