Cops ‘harass’ MLA over leak

| 08/11/2012

dart shovels.JPG(CNS): The independent member for North Side said he has been “harassed” by the RCIPS about the leak of the agreement between the NRA, Dart and government relating to the West Bay Road projects and the ForCayman deal. Ezzard Miller said he was appalled, not only by the attempted intimidation but the complete waste of public resources investigating the leak of a document that should have been in the public domain all along. Miller said the behind closed door deal, which was posted on CNS, was sent to him in the mail and he had no idea which concerned citizen had sent it to him. But, regardless of the source of the leak, the MLA said there was absolutely no need for the police to be involved.

Miller told CNS that, while enjoying coffee a few weeks ago, he was approached by a stranger, who had identified himself as a police officer wishing for a private word. Miller said the officer told him he was investigating the leaked NRA/Dart document but the MLA made it clear he was not prepared to talk to him on the street. As a result, he agreed to go to the police headquarters. It was there that Miller discovered that the investigation was being conducted by the Financial Crimes Unit, although the officers could not identify what crime exactly had been committed and stated that the enquiry was about a breach of protocol at worst.

“I was shocked to be sitting down having coffee and approached by someone I didn’t know … that turned out to be a police officer investigating the leak,” said Miller. “I told him how I got it sent in mail but pointed out that I believed this was a colossal waste of government resources at a time when crime levels are as high as they are. It is absurd to have police spending money trying to find out how a released a document, which should have been in public arena even before it was signed, made its way into my hands.”

In what Miller described as a worrying, if not sinister, move, he said the police had made it clear he was not suspected of a crime and that there was, in fact, no criminal activity related to the leak, but the independent member said that the requirement for him to give a statement was clearly harassment.

“I think this was intimidation and an attempt to harass me when all I am doing is the people’s business. Sadly, however, this is the kind of government that we have,” the North Side MLA said as he indicated that he was confident about who had made the complaint to the police and instigated an investigation into the leak.

Miller also said it made a complete mockery of the premier’s persistent claims that the ForCayman Alliance deal was transparent.

This sentiment was echoed in the Legislative Assembly on Thursday morning by his colleague from East End, when Arden McLean demanded that the premier explain how he could possibly claim the deal with Dart was transparent when Miller was being investigated by police officers over the leak of the document.

The premier has stated on several occasions that the deal has been transparent, although, even at this stage the full parameters and details of the deal remain unclear. No documents that government have signed or intend to sign have been released officially. The full review by PriccewaterhouseCoopers on the proposed deal also remains under wraps. Although Dart has published limited and broad outlines of its proposals, the only details so far have come from the leaked agreements.

The document, which was sent to Miller in a plain brown envelop, was signed between government, the NRA and Dart in December last year and was published in full by CNS in July.

The RCIPS confirmed Thursday afternoon that an equiry was underway but gave few details.

"We can confirm that the RCIPS has recieved a complaint from the National Roads Authority, in relation to the possible disclosureof confidential documentation. An investigation into the matter is ongoing. In the course of the investigation we have spoken to about a dozen people so far. However, as the enquiry is active it would be inappropraite to comment further at this time," the police spokesperson stated.

Ezzard by name, Hazard by nature.  If anyone thinks for 2 seconds this man is fit to lead or play a part in Cabinet they are delusional.  He would do more harm to Cayman's economy than Mac has managed, and that is saying something.

I was proud of Ezzard on " The Panel " onCayman 27. He ALLOWED the people of Cayman to hear and see how deranged KEKE  has become. He proved to me once and for all that he hasn't got a clue why people voted for him in the first place. " It was to fix all the problems PPM put us through by overspending on three schools and placing the cruise ship piers in a very wrong place ( on top of the most beautiful reefs in georgetown)" .

KEKE proved he doesn't have a clue on what he was voted for. Ezzard wanted people to hear how ridiculous his running of Gov't is. KEKE is only bringing up the PAST instead of producing a FUTURE for our ISLAND. He only talks about what PPM did. Noone gives a shit about what they did .Its the past , can't he understand that? We want a leader to fix the present and create a future !! NOT TALK ABOUT THE PAST !!!

KEKE still could have had a cruise ship pier if he had built it when he built ROYAL WATLER in the past . But he doesn't bring up that past arguement so why bring up PPM failure??

Get to work and stop vacationing around the world and get things moving so that our children stop leaving the country to look for a job!!!!!!

Ezzard Miller for Premier !!!  Ezzard, irrespective of what others may say or think, I am a born and bred Caymanian and as far as I can see, you are standing up for the betterment of these Islands and the people! I hope Caymanians will vote for a better Cayman, better future and for better governance and protection come next election and get rid of those who have been stepping on us and pounding us deeper into the mud.

That's right. Doesn't he know that these things are supposed to be hidden from the public so they have no idea what is going on? Troublemakers talking about transparency.  We prefer to be treated like mushrooms – kept in the dark and fed sh!t.

Lord, help us. I can't wait for the day we can be rid of Bush and his lot and start to get our country back if it's not already too late. If the tendering for the new dock had been handled correctly from the start it would have been half completed by now. We have terrible governance and, crazily, a premier who doesn't believe the public has the right to tell him what to do – a most peculiar attitude from an individual who, in my opinion, is totally unfit to hold the position of premier.

If the Police can not make a determination on Mr. Bush's "breach of protocol" when he misused the power of his office to try to influence the release of massive amounts of explosives, why should they be wasting time about this "breach" of put out in the open that which should have been all along.

Really??? I have reported numerous violations of laws to several MLA’s, the OCC, the DPP, and numerous government agencies and NOBODY has done ANYTHING…NOBODY…my rights have been violated…and people are worried about the RCIP investigating a leak? I agree, a complete waste of resources… But who’s giving these directives? I wish the RCIP was investigating actual crimes and real violations instead of political witch hunts! The RCIP definitely has job security with these idiots!

Somehow this all starts to feel a little bit like either "1984" or "Animal Farm"… I don't expect Keke to stay at power past the next election (if he doesn't use a funny trick, like losing he voter's registers and then we have to postpone the election until 2017 or so) but it will be interesting to see how strong the web is that he build up here on the island. His fellowers that have been moved to important positions over the last years will still be powerful. Keke might be gone after May… but his shadow will still be over this island.

Unbelievable…if the government is involved, there should be NO secret deals! If everything was transparent and above board, the people would have access and there would be no need to investigate, justify, or cover-up. Both parties are guilty…then the power struggle and blame games begin. Then the words incompetent, irresponsible, outrage and appalling come to mind. Seriously, when does this cycle end? Stop the cycle, be part of the solution…but the entire government needs to quit playing politics, the media needs to stop playing favorites, everyone needs to grow a conscience…but the mess is soooooo big!! Really, this place is toooo small…lets work together, develop a team and a community, work smarter not harder…and enjoy the benefits together rather than put so much effort in one upping each other. No wonder we need an entire day on Sundays…to ask for forgiveness for the sins committed all week!!!

The RCIPS, by their own admission, allowed hundreds of extremely confidential documents relating to the original Tempura investigation to be unlawfully removed from the Cayman Islands but decided to do nothing about it. The FCO then compounded the crime by accepting, and investigating, an apparently totally malicious complaint based on these records without questioning the source of the material used.

Now, when an elected representative uses the contents of documents apparently already in the public domain (or if they weren't theyprobably should have been) RCIPS run round like the NRA's trained poodles investigating an alleged 'breach of protocol'.

As people keepsaying, "You couldn't make this up if you tried."

      • Anonymous says:

Actually 2 names.  Remember who is on the receiving end of this deal?  There are always 2 parties at least to a deal, so if is not one, it would be the other who started this witch hunt.  And for what, I dunno, because this is information that the public has a right and entitlement to see and be privy too.  If CIG is part of this deal, then NOTHING ABOUT IT SHOULD BE CONFIDENTIAL OR SECRET OR HIDDEN  from the taxpapers.

This is a man with too much wits for a bunch of dim wits.  Offer what input to whom? let him tell the people of NS what he intends to do not a bunch of politician who are too high and mightly and will not listen to anyone.  I myself found it very entertaining.  Eagles soar, Turkeys gobble.

I used to be on your side Mr. Miller, but after watching "The Panel" on Cayman27 the other night where you smiled at the premier, laughed at a few jokes he made and the rest of the time kept your mouth shut!! well it's clear you can talk a big talk on Rooster in the mornings but can't walk a big walk when face to face with the Premier.  The opposition leader stood his ground and argued the facts, while you just sat their like Oliver Hardy…. Well "that's another fine mess"  you had the chance to speak to the Cayman people and you kept your mouth shut.

    • Anonymous says:

which show did you watch or were you using rose coloured glasses I saw Ezzard tring on several occassions to move the conversation away from blame and to talk about solutions, like addressing the PMFL and the immigration situation

Ever one knows Ezzards position. Just because you didn't get to see a verbal assault or boxing match, you believe that "no one sttod their ground?!!! Give me a break. Ifthat is all it takes to change your mind…then that explains a lot about how we got in this mess to begin with!!!

Yep, president hot air is up in the air. Ezzard, sure has rattled some cages by not being confrontational and making himself look like a spoil two year old with a temper tandrum on the Panel.  Ezzard, you conducted yourself like a chess master, this is where one really appreciates wisdom and intellect rather than brawn without brains.  There is an old proverb and I will attempt to quote one line "he who knows not and knows not that he knows not is a fool shun him".

    • Anonymous says:

Poster 17:12 you are way out of your league and need a lesson in politics and diplomacy.  Ezzard did the right thing.  An intellegent person knows the appropriate time to listen and when to speak. Mr. Miller was in his zone on "The Panel".  Tuesday mornings is his time to speak to the Caymanian people.  The Premier and the opposition leader had their perfect opportunity to speak to the Cayman people then and I did not come away with anything except the blame game and defence, althought highly entertaining.  I will leave you with one example of smart vs foolish.  Back in the presidency of  President George W. Bush there was a disagreement between him and Russian President Putin concerning some issue over Iraq that President Putin did not agree with and because of the coliation that the USA had with other nations he decided to threaten Putin and used his famous worlds "if you are not for us you are against us".  I remember clearly Putin going almost expressionless (except for a mischevous twinkle in his eyes) to the TV cameras and saying "Well comrades, president wolf is at the door".  That was diplomacy now you go figure that out.

    • Anonymous says:

I do not condone the disclosure of confidential information but persons in the department should be investigated not the member from NS.  Remember the lead about the Abu Ghraib torture and prisioner abuse leak. Did the US government prosecute 60 Minutes for receiving the information and publishing the information? I think not.  This government had better stop harrasing innocent people because information travels fast now and they just might find themselves the focus of much investigations by the UK.  We need to be very careful what we say and do because remember CNS is electronic and goes world wide.   So this my friend just goes to show that the pen is mightier than the sword.

  27. Anonymous says:

This is crazy.  Why don't the RCIPS prosecute the REAL criminals, instead of harass someone who is merely giving information to the public that the public has a right to in the first place, seeing that we all pay taxes, whether indirect or direct or whatever you want to call it.  NO TAXATION WITHOUT REPRESENTATION, and while we are at it, NO TAXATION WITHOUT FULL ACCOUNTABILITY AND TRANSPARENCY !!!   Come on RCIPS, get your priorities in order.  There are real criminals, robbers, rapists, murderers running around, and there are 3 outstanding criminal investigations into our leader which for some reason is dragging on for an ENORMOUSLY LONG TIME, yet you have time for this NONSENSE???  UNBELIEVABLE !!!  What next, you are going to start harassing whistleblowers???

You may be right on that, but it does the Cayman Islands and her people a massive dis-service to allow William McKeeva Bush one more nano-second in the position which he now so incongruously fills. Whether one likes Mr. Miller or not, this is indicative of the negative effect which both the udp and Kenneth Dart have on the Cayman Islands. What is happening here in Cayman is a complete travesty of justice.

  34. wayasay says:

Get back to work RCIP.This is grazy.

The Police admit that there is no suspicion of a crime being committed, yet the commercial crimes branch have the manpower and resources to harass a private citizen going about his business? It matters not that Mr. Miller is an MLA, if we all do not condemn these kind of actions now, who will condemn, or stop it, whenthey come for me on some non criminal investigation? Even worst, who will stop them when they come with a criminal charge that is intirely made up.

Mr. Chief of Police, you are doing a good job of identifying at least one department that should be cut to balance the budget. If you have manpower to do a job that they are not hired to do, then you have too many officers on your payroll and you should get rid of some of them.

I will not get into the inefficiency of RCIP in combating real crime locally, except to say that the time wasted investigating how Ezzard got a document that the citizens of the Cayman Islands should have got up front, would be far better spent doing your job to solve some of the unsolved crimes such as murder.

I am wondering if Mr. Ezzard is not being a touch dramatic here. Maybe, just maybe, the Police Financial Crimes unit, as the name suggests, was in fact investigating the financial aspects of the deal between Dart and Mac?
