Child rapist’s sentence sticks
(CNS): The Cayman Islands Court of Appeal has upheld a sixteen year sentence handed down to a 30-year-old man following his conviction for the rape and sexual assault of a 6-year-old girl. The man, who cannot be named because of a law prohibiting the publication of anything that could identify the victim, is from Cayman Brac. He will now serve the sentence handed down by the chief justice as the appeal court did not agree with the man’s attorney that the sentence was excessive. The panel dismissed the appeal following submissions by John Furniss, who argued that in comparison to other local cases of stranger and violent rape, the sentence was long.
However, the appeal judges disagreed and said that given the number of aggravating features and no mitigating features at all, the judge was entitled to pass the sentence that he did.
“We find it impossible to say that the sixteen year sentence imposed by the judge was excessive,” Sir John Chadwick, the president of the appeal court, said as he pointed out that, in accordance with the guidelines, the sentencing judge was entitled to start at fifteen years if he wished and add more time for the aggravating features
The three judge panel pointed to the fact that not only had the appellant, whose appeal against conviction they had dismissed in a previous appeal court session, been convicted of two counts of rape and two counts of sexual assault on a child who he was trusted with as she was a relative of his wife, the rape and assault had been repeated over a four month period. There was the further aggravating factor of degradation as a result of him forcing the child to give him oral sex, plus the offender had a previous conviction for the sexual assault of a work colleague.
The appeal court was also expected to hear another rape case Monday but the 47-year-old West Bay man, who is serving 12 years for the rape of a teenage girl, asked for an adjournment to the winter sitting of the higher court in order to apply for a Queens Counsel to handle his appeal.
Tyrone Ebanks, who wishes to appeal both the conviction and the sentence, was found guilty last September, following a judge alone trial before Justice Michael Mettyear, for the rape of a 14-year-old girl, whom he dragged from her bicycle as she passed his house.

I as a mother do agree with the sentence if what is alleged is truth, personally i would have castrated him.
Unfurtunately I have seen in one particular case where the mother of a child cried rapeon her husband because she was having an affair and had gotten pregnant for another man and needed the husband out of the picture so like a good sheep she cried wolf only to ruin her daughter life!
I think she should have been in prison but no! she went on and had another two children and currently she puts all four kids to sleep at night around ten oçlock (all under the age of ten) and hits the streets to party like it's ok. When she is drinking she brags of how she got rid of her husband. This kind of thing is what is going to hurt the ligitimate cases of sexual abuse againt our kids!
And further more you do not take your teen age daughter out on the town to get drunk and end up at Nene's all hours of the morning to celebrate putting alledged molester behind bars! so I think that in cases where these sexual abuses goes on they need to investigate and make sure the parent that is making the allegation is a good parent and that if there are any other kids at home that they are safe.
What they need to start make sure is that these kids that are being molested are being helped because there are high chances that when a child is molested he or she will become a molester! (and believe me in one particular recent case it is already happening)
So yes lock the bastards up make sure that they are not looked up on "here say" but on facts! and then make sure the child receives proper help and that the enviroment the child is left in is a safe enviroment.

Who are we to judge!!!
If this man is truly innocent like many others we would have wrongfully judged him and this should not be so. think of the family of the accussed and imagine the shame and embarassment they would have faced, knowing that he was wrongfully judged. But i believe that bad things happen to bad people and eventually if this is a lie the truth will be revealed and god will punish those who accuse people wrongfully.

FYI – 16 years in prison means he will be eligible for parole in about 6 years!
Judges know this, so their sentences should automatically be longer!

I have a 6 year old daughter. I cannot imagine anyone violating her and if they did, I would kill them and face God later.
These sub-humans should be put away for life but before they are locked up they should have the same done to them that they inflict on others. There are too many of them walking around in society pretending to be upstanding citizens with businesses and families, that should be locked up and named and shamed for crimes committed before we had people like Sandra Catron and a working justice system.
16 years is too short of a sentence for the crime he commited!
I have a 9 year old daughter & reading this story breaks my heart. I can only imagine what that 6 year old has been put through (mentally & physically). God in Heaven knows if that was my child or niece that was hurt by that MONSTER, he would be chopped up so fine that you wouldnt be able to smell him!!!
The punishment for rape of a child/woman should be CASTRATION, no if's, and's or but's! That way we know he would not be able to rape another living soul.

What mitigating features could possibly be in a rape of a child? Who could possibly look and find so called mitigating features? He should not get out a day earlier than after 15 years served, and after that, every person should know the day he is released.

Lock them all up!!! It is a shame that the crime of rape carries such low prison sentences. People who are assaulted will live with that pain and shame all of their lives. No one is worse than a child molester, they are feces!!

Unfortunately, more often than not it is a member of the child's family who is the molester. Children are so trusting, particularly with family members. Mothers, be very, very careful who has access to your children, on a one on one basis. Male or female.

Sixteen year sentence for raping a child is nothing compared to the life sentence of shame and anquish that was handed down to that child. As far as I am concerned, he should have gotten life.
I think the sentence was much too light. Anyone that would do that to a six year old girl deserves to have his nuts crushed and his penis severed. Then he should be sent to a place where all the males of the girls family will be waiting with cow cods to whip his naked rump. After that he can start his sixteen years!!
Only 16 years ? the child was only 6 years old, in cases like this these scums should be given at least their age to serve, in his case 30 years.
If you send him to a real jail it won't matter how long the sentence is.
Thank God we now at least have an "unofficial Sex Offender Registry" on FB. In time this dogs identity will be public knowlege so we can all be aware of who this criminal is and we can help keep our children safer knowing who is actually preying on them. I hope people will stop focusing on and attacking gay men and women and put their energy into something more worthwhile like protesting violence against women and children and fighting for revamped laws and stiffer punsihments for the perpetrators. Gays and lesbians are not the ones involved in domestic violence, rape, pedophilia, murders, beastiality and other such behavior, yet there is always some non issue arising about the LGBT community while these insipid low-lifes are kept protected from their "dirty little secrets". Rape of a six year old? Sixteen years excessive? How about adding castration to the 16 years? I sincerely pray that the child will get the therapy she will need to help her become as healthy (psychologically) as possible. Unfortunately, the little girl was sentenced to life!

Life in prison without parole is the correct sentence for a crime like this.
The Cayman Islands Government need to create a Sex Offender Registry and names listed for the Public to see. Everyone needs to know who the Sex Offenders are and where they live.
