Child rapist’s sentence sticks

| 30/07/2013

(CNS): The Cayman Islands Court of Appeal has upheld a sixteen year sentence handed down to a 30-year-old man following his conviction for the rape and sexual assault of a 6-year-old girl. The man, who cannot be named because of a law prohibiting the publication of anything that could identify the victim, is from Cayman Brac. He will now serve the sentence handed down by the chief justice as the appeal court did not agree with the man’s attorney that the sentence was excessive. The panel dismissed the appeal following submissions by John Furniss, who argued that in comparison to other local cases of stranger and violent rape, the sentence was long.

However, the appeal judges disagreed and said that given the number of aggravating features and no mitigating features at all, the judge was entitled to pass the sentence that he did.

“We find it impossible to say that the sixteen year sentence imposed by the judge was excessive,” Sir John Chadwick, the president of the appeal court, said as he pointed out that, in accordance with the guidelines, the sentencing judge was entitled to start at fifteen years if he wished and add more time for the aggravating features

The three judge panel pointed to the fact that not only had the appellant, whose appeal against conviction they had dismissed in a previous appeal court session, been convicted of two counts of rape and two counts of sexual assault on a child who he was trusted with as she was a relative of his wife, the rape and assault had been repeated over a four month period. There was the further aggravating factor of degradation as a result of him forcing the child to give him oral sex, plus the offender had a previous conviction for the sexual assault of a work colleague.

The appeal court was also expected to hear another rape case Monday but the 47-year-old West Bay man, who is serving 12 years for the rape of a teenage girl, asked for an adjournment to the winter sitting of the higher court in order to apply for a Queens Counsel to handle his appeal.

Tyrone Ebanks, who wishes to appeal both the conviction and the sentence, was found guilty last September, following a judge alone trial before Justice Michael Mettyear, for the rape of a 14-year-old girl, whom he dragged from her bicycle as she passed his house.

I as a mother do agree with the sentence if what is alleged is truth, personally i would have castrated him.

Unfurtunately I have seen in one particular case where the mother of a child cried rapeon her husband because she was having an affair and had gotten pregnant for another man and needed the husband out of the picture so like a good sheep she cried wolf only to ruin her daughter life!

I think she should have been in prison but no! she went on and had another two children and currently she puts all four kids to sleep at night around ten oçlock (all under the age of ten) and hits the streets to party like it's ok. When she is drinking she brags of how she got rid of her husband. This kind of thing is what is going to hurt the ligitimate cases of sexual abuse againt our kids!

And further more you do not take your teen age daughter out on the town to get drunk and end up at Nene's all hours of the morning to celebrate putting alledged molester behind bars! so I think that in cases where these sexual abuses goes on they need to investigate and make sure the parent that is making the allegation is a good parent and that if there are any other kids at home that they are safe.

What they need to start make sure is that these kids that are being molested are being helped because there are high chances that when a child is molested he or she will become a molester! (and believe me in one particular recent case it is already happening)

So yes lock the bastards up make sure that they are not looked up on "here say" but on facts! and then make sure the child receives proper help and that the enviroment the child is left in is a safe enviroment.

The bible saysJohn 8:7 – So when they continued asking him, he lifted up himself, and said unto them, He that is without sin among you, let him first cast a stone at her…

    Who are we to judge!!!

If this man is truly innocent like many others we would have wrongfully judged him and this should not be so. think of the family of the accussed and imagine the shame and embarassment they would have faced, knowing that he was wrongfully judged. But i believe that bad things happen to bad people and eventually if this is a lie the truth will be revealed and god will punish those who accuse people wrongfully.

and for those who are calling this man a BASTARD take a look in the dictionary and if you dont have one here is the meaning for you…

    [bas-terd] noun

a person born of unmarried parents; an illegitimate child.
Again who are you to JUDGE!

Hello, just a little piece of info here for all.

While I agree that anyone who molests a child should be shot, I do believe that there are instances where there has been Psychological coercion on the part of a family member (espeacially mothers), the Police or that there are some that are sexual predators themselves, but when thet get caught, they cry RAPE, and yeah I've seen some at local events that look and act as adults, and that if it was my child, I would've ashamed to know that was my child.
Just something to bear in mind, there have been convictions here on island where there was NO evidence, other than their word against another's word, even after there was so many inconsitancies in the accusers story.
On another note, whilst I agree that there should be a sex offender registry, I don't believe anyone but gov't should publish it, espeacially the current JAFO (just another f***ing opportunist) looking to gain a rep off of someone else's downfall.
As it is written, let not ye judge, lest ye be judged yourself.

FYI – 16 years in prison means he will be eligible for parole in about 6 years!

Judges know this, so their sentences should automatically be longer!

A Shame & disgrace what's still happpening to our innocent children.

Where do you get your information from?! it'll be more like 9 years before he's even considered…..

I have a 6 year old daughter. I cannot imagine anyone violating her and if they did, I would kill them and face God later.

These sub-humans should be put away for life but before they are locked up they should have the same done to them that they inflict on others.   There are too many of them walking around in society pretending to be upstanding citizens with businesses and families, that should be locked up and named and shamed for crimes committed before we had people like Sandra Catron and a working justice system.

16 years is too short of a sentence for the crime he commited!

I have a 9 year old daughter & reading this story breaks my heart. I can only imagine what that 6 year old has been put through (mentally & physically). God in Heaven knows if that was my child or niece that was hurt by that MONSTER, he would be chopped up so fine that you wouldnt be able to smell him!!!

The punishment for rape of a child/woman should be CASTRATION, no if's, and's or but's! That way we know he would not be able to rape another living soul.

    • Genius says:

Was that a serious preposition or were you just possessed by a medival executioner? How bout we take all those castrated rapists and form a choir also?

  8. Anonymous says:

Make no mistake, he will reoffend when released from jail.  16 years in jail is not enough.

As it is the nature of a fish to swin, raping is the nature of a child rapist.

Human rights fails the test, when you consider the lack of human rights for the 6 year old child.

What mitigating features could possibly be in a rape of a child? Who could possibly look and find so called mitigating features? He should not get out a day earlier than after 15 years served, and after that, every person should know the day he is released.

Victims of rape or other crimes, please look into BSFF- a Therapy method for eliminating the emotional roots and self-limiting belief systems that are embedded in the subconscious mind, and which automatically determine and control most of our experience, self-expression and behavior. There is not more effective and simple therapy exists and it is worldwide accepted and you can do it yourself- material available online, it is affordable, with 100% guarantee-you get your money back if it is not working for you.  Parents of children-victims, please act now. As a mother of such a child, I know what it does to a child in the long run if left untreated.

Lock them all up!!! It is a shame that the crime of rape carries such low prison sentences. People who are assaulted will live with that pain and shame all of their lives. No one is worse than a child molester, they are feces!!

  11. Anonymous says:

Sorry but this is one crime I feel a death sentence would be more than justifiable.

How can you bring yourself to do that to a child!!!!!!!!!!!!

  12. Hoping for better days says:

SICK. They need to be made public. WE deserve to know who these criminals are because this has been happening for the last 30+ years in Cayman. Not just today folks.

  13. Anonymous says:

16 years? That bastard should be castrated…. poor girl may never recover from the trauma and he gets 16 years….probably to come out and do it again!

  14. Anon says:

  15. 4 Cayman says:

Actually he should be castrated. No more appeals and wasting of court time!  A six year old is still a baby and a baby needs protection from families and loved ones. Not to be pry on and taken advantage of……sick, sick, sick!

    • Anonymous says:

Don't worry. Some human rights idiot will be fighting to have him release earlier, as this is a in-humane sentence.

He should be spending the rest of his life in jail as far as I am concern.

To those of uncomfortable and unsatisfied natures that get sexually arouse when they can't help but glimpse a bit of heaven in the very young and innocent child:  You are addicted sir, to internal forces that many other men in their own strength can never overcome, nor can the world understand your world and fantasies. You are sick and need a spiritual and psychological physician!  But if you can but "see" in your own minds eye, the images of pornography, and if you can but "feel" the sensations through your body and spine at work – note that a first step of your recovery will be that you have realized how conditioned you are to these images and sensations combined, and it has made you into a child-monster!  You can help yourself by realizing that what you are conditioned to, will only create a misery in you that will haunt you and make you into a worse person than you are now. Be a man and occupy yourself with nature and get out of the perverted head-world that is dark and makes you believe heaven is what it conjours up. Alot of people have overcomed addictions before. Yours will take deep self-reflection and dedication. Meanwhile, stay far far far away from the young and innocent children on these islands. This is Cayman. People have machetes in their homes, and people will use them and ask questions later. I know women here don't play!  They will kill for their sons and daughters. And for crying out loud, don't join a church and talk about going into the ministry to save people when you are spiritually sick yourself. You must save your self and repent… that was the message of Jesus!  Moreover, don't break our laws and harm our children in what ever way!  I think Cayman has no rehab center for people like your self. Please move if you have to and live some place else other than the Cayman Islands until by God's grace, you can cure yourself of your sickness.

Unfortunately, more often than not it is a member of the child's family who is the molester. Children are so trusting, particularly with family members. Mothers, be very, very careful who has access to your children, on a one on one basis.  Male or female.

      • Hoping for better days says:

Notice someone keeps hitting "troll". I have no doubt in my mind the person doing this is one if these very sick people, or someone who condones this sick behaviour. And yes you are right alot of times these molesters are close to home, family to the victim. What future do our children have if this is the childhood they are subjected to????

Any man that has done this should have his hands chopped off, castrated, and the list goes on. You know why? You had no mercy on the 6 year old LITTLE girl you raped. she may never have children, could be infected now because of the sick bastard.

      • Anonymous says:

Father's need to be careful too. As you say male or female.

Sixteen year sentence for raping a child is nothing compared to the life sentence of shame and anquish that was handed down to that child.   As far as I am concerned, he should have gotten life.

  19. sombodi hep mi plees says:

I think the sentence was much too light. Anyone that would do that to a six year old girl  deserves to have his nuts crushed and his penis severed. Then he should be sent to a place where all the males of the girls family will be waiting with cow cods to whip his naked rump. After that he can start his sixteen years!!

  20. Anonymous says:

Only 16 years ? the child was only 6 years old, in cases like this these scums should be given at least their age to serve, in his case 30 years.

  21. Anonymous says:

If you send him to a real jail it won't matter how long the sentence is.

  22. Anonymous says:

Thank God we now at least have an "unofficial Sex Offender Registry" on FB.  In time this dogs identity will be public knowlege so we can all be aware of who this criminal is and we can help keep our children safer knowing who is actually preying on them.  Thank you Sandra and thank you to those brave women and little girls who have exposed these evil devils.  I hope people will stop focusing on and attacking gay men and women and put their energy into something more worthwhile like protesting violence against women and children and fighting for revamped laws and stiffer punsihments for the perpetrators.  Gays and lesbians are not the ones involved in domestic violence, rape, pedophilia, murders, beastiality and other such behavior, yet there is always some non issue arising about the LGBT community while these insipid low-lifes are kept protected from their "dirty little secrets".  Stop the insanity people and let's wipe out the real problems here, not the imagined ones of our backwards and ignorant population.

  23. Anonymous says:

There is noting in keeping this mansidentity a secret. All of us in the Brac k ow who it is and what he did. The identity of the victim is not hidden or protected . May he rot in jail and never be able to hurt another child again

  24. Anonymous says:

Rape of a six year old? Sixteen years excessive? How about adding castration to the 16 years?  I sincerely pray that the child will get the therapy she will need to help her become as healthy (psychologically) as possible.  Unfortunately, the little girl was sentenced to life!

  25. Anonymous says:

Cannot be named? Sandra going have his name all over facebook very soon..

    • Anonymous says:

And hopefully contempt of court proceedings will follow.

      • Anonymous says:

Why? We should support Sandra's efforts because it informs the public of those among us who have been convicted of committing heinous crimes against our children. Don't like the idea of us knowing who might be a serious threat to our kids? You are as much a part of the problem as the offenders!

  26. Anonymous says:

Foolishness, Catron gonna have his name plastered on Facebook by Morning!!!!!!

  27. Anonymous says:

Life in prison without parole is the correct sentence for a crime like this.

    • Phillip Walton says:

The Cayman Islands Government need to create a Sex Offender Registry and names listed for the Public to see.  Everyone needs to know who the Sex Offenders are and where they live.
