Court moves on Rivers case

mac n tara (232x300).jpg(CNS): The court has moved quickly on the necessary proceedings over the challenge filed against the election of C4C member of the Legislative Assembly, Tara Rivers. According to the cause lists for this week, the Rivers case is listed for a directions hearing on Tuesday afternoon in Grand Court Five. The election petition filed last Wednesday, as revealed by CNS, queries the new education minister’s qualifications to be an elected member on two grounds. John Gordon Hewitt, the husband of Velma Hewitt, the UDP candidate who finished fifth in the West Bay poll, has petitioned the courts stating that Rivers has a US passport and was not resident in Cayman for the seven years prior to the election as required.

So far, Rivers has not commented on her qualification but released a short statement Friday saying she would be defending her election to office and fighting the challenge. The PPM leader and new premier, Alden McLaughlin, who invited Rivers into his Cabinet in the immediate wake of the election, even though she ran on the Coalition for Cayman ticket, also offered his support to his Cabinet colleague.

It is hoped that the issue will be resolved quickly as it is very likely that, should Rivers lose the challenge, a by-election will need to be held in the district because of the significant number of votes achieved by Rivers in the General Election. It is unlikely that Velma Hewitt, who came in fifth, would have been the major recipient of Rivers’ votes if she had not run as the C4C candidate, as they were seen as an anti-UDP vote by many. Had she not participated, a significant portion of her votes may well have gone to one of the other 11 candidates in the West Bay race.

With a very recent precedent set in the Turks and Caicos by former Cayman magistrate Margaret Ramsey Hale, now a judge in that territory, Hewitt’s challenge, if successful, is unlikely to result in the requested automatic return to office of his wife.

The challenge was filed just ahead of the deadline on the three week window of opportunity provided for by the elections law but it was not unexpected. The issue of Rivers being out of the country for a large part of the seven years prior to the election had been queried prior to the national poll but Rivers had made no comment on the issue.

In addition, on Nomination Day Rivers was one of a half dozen or so candidates who refused to sign a voluntary declaration document created by the Elections Office to focus candidates' minds on the various qualification requirements in an effort to reduce the risk of a challenge to any of them.

It is no secret that Rivers was working in London between 2006 and 2009 as an associate at a law firm. However, she has reportedly claimed that she was also a student at the time and said it was not an issue. The elections law does provide some exemptions to the seven year residencyrequirement for candidates ahead of qualification, including being off island in order to study. However, it is not clear if that relates to those studying abroad while also holding a full time job overseas.

CNS contacted C4C committee members, who had claimed to scrutinize all of the candidates they had endorsed, to ask if they had satisfied themselves that Rivers did not hold dual nationality and that her absence from the islands was legitimately covered by the law. But the advocacy group, which has positioned itself on a platform of accountability and transparency in government, has not responded.

    Velma is not the issue here.

     Whilst Tara is a very good fit for the position of Education Minister given the opportunity she like all others needed to declare all documents.

    Then, the readers of CNS wouldn't have to make so many malicious comments, Govt time and money wouldn't be wasted and we could move forward trying to revitalize our Education system.

    I hope this madness will soon be put to rest!!!

    i dont think the issue is wether she is quilified to serve our country but  wether she was quilified to run in the 2013 election. there are laws in everything in life as there is when it comes to being in politics that we have to live by and follow. i do feel that Tara would be good for our islands but she has really gotten off to a very bad start.

    The other person seeking justice is now being made out as the bad guy according to the comments on this page.

    If the purpose of the wording in the Constitution is to ensure a candidate is sufficiently Caymanian to be elected as an MLA, and that candidate was deemed to be so in 2000, then it follows that the same candidate will be eligible to run in 2013, regardless of how many years the candidate has studied or worked abroad.

    It is quite unfortunate that this matter will have to be drawn through the process and expense of our courts.

    The way things are stacking up, I sincerely hope that Tara has an excellent explanation.

    I say this because at the time of nomination she was fully aware of whether or not she was eligible.

    Furthermore, one of her running-mates on the C4C ticket (Kent McTaggart) pulled out of the race on the very basis of questions surrounding his residency. Therefore, in addition to the issue being a nagging reality in the back of the mind of any Caymanian political hopeful that merely contemplates some time abroad – she had a full-frontal reminder of these requirements by way of his withdrawal.

    Tara really ought to tread carefully on this one because she is still young and I would hate to see her political career ruined before it even starts. If this ends badly for her she will be forever written off in my book – and hopefully everyone else's.

    Any political hopeful that is willing to play chicken with our constitution does not deserve the honor of representing the people.

    May justice run its course.

    Caymanian lawyers practiing overseas is the same as the lawyerspracting in Cayman Law in Hong Kong and the US..  The difference are who are making the money..

    Whislt Tara was the BEST choice west bay could have ever elected because of her well educated portfolio , we realize that Justice is also Justice. It is as simple as Tara showing a few documentations… However she states that she will defend herself vigorously. I go on to say However Tara was still the peoples choice. She made History in West Bay when she broke The UDP cycle. To be honest she would have represented us well , you can see it by even the way she speaks…But if she knew she was not eligable to run , she should have never partaken in this election. Now to Ms. Velma… You must really have wanted a seat bad, In my opinion If you knew this you should have spoken up, I bet if you won a seat Ms. Tara wouldnt be an issue.. And how are you so sure if Tara didn't run the people of west bay wouldnt have casted their votes to someone else besides you… Even if you do get a seat, I dont think you'll be returning Come The next election… Wow people can do alot ehhh… Besides I still believe Tara is Caymanian at Heart…Better than some of them who in their that have no education, they don't have cayman at heart and just want the paychecks….     If it turns out that Ms. RIvers knowingly ran while being ineligible then she should be held accountable.  A budding lawyer should be smart enough to see there was potential for conflict here and should have confirmed she was in the clear before she ran.

    She got a lot of votes.  Who knows how things would have shaken out if she had not been in the mix.

    If there is a run-off I think that the people of the Cayman Islands should send her the bill the costs of the new election.  It wont be cheap and we as a country dont have extra money lying around.  Shame!

    Please help as I am confused:  According the this previous post from the Constitution, wouldn't this trigger an island-wide by-election, not just a district – as the constitution itself doesn't speak of a district seat particularly?  Thanks in advance for any clarification.

     

    The Cayman Constitution would seem to require a by-election.

     

    Secion 86 (2) reads:  

    (2) Whenever any person vacates his or her seat as a member of the Legislative Assembly for any reason other than its dissolution, an election to fill the vacancy shall be held within two months after the occurrence of the vacancy, unless the Assembly is sooner dissolved or the date on which the Assembly must be dissolved under section 84(3) is less than four months after the occurrence of the vacancy.

    Funny how 4 years ago it was ok for John John Seymour and Mark Scotland to be challenged  in court because they didn't declare their interests on time but it's so wrong for Tara to be challenged now because she seemed to have gotten elected illegally. When the shoes is on the other person's foot the expereince is totally different.

      The Seymour/Scotland challenge was issued outside of the required time to file such issue(s) with the court as the law is currently written.

      If the ineligibility is proved, she should be required to pay legal costs and the costs of any by-election.  Why should the public pay for an improper attempt at election by an ineligibile candidate?

    Will everyone stop talking about Velma! She is not the issue here. The issue is whether Tara is eligible ( and that is looking very questionable).. If she isn’t there will clearly be a bye-election, as the have as many votes as you want system means there is no other option.

      What you couldn't hear the quite wisper from the ivory towers?  C4C has lost it's way, and is nothing more than a bad joke.  They have rode the coat tails of the individuals who had an audence and a reputation, taken advantage of disgust with our political enviroment to make a brand, and now that brand is more important than anything else.  Sad, I think it could have been a good thing.

    She has started off on the wrong foot and holding back on the necessary documents to prove people wrong or right will only dig a deeper hole for herself and cast alot of doubt in people's mind about her being trust worthy.

She has been challenged by an American married to a Caymanian wanna be politician and she must therefore answer the charges where they were brough, in the court of law. I hope she wins but if she does not so be it. However, and it is a big HOWEVER, Velma will not waltz in to replace her which is what the man is asking for in his suit.

    Conyers Dill & Pearman's biography of Tara Rivers on their website certainly seems to suggest that she was working full time for Allen & Overy in London as an International Capital Markets Associate and also that she had a secondment to Citigroup whilst she was in London. Even more telling, her education, as listed on the same web page, makes no mention of any studies beyond 2005 when she got her LLB at York University. Her biography also suggests that she was called to the bar in New York and Ontario in 2006 and Cayman in 2009 but makes no mention of her being called to the bar in the UK. I begin to see why she refused to sign the declaration form…

      This says it all really. She clearly was not a student in the UK. She was there to gain experience, which is both commendable and worthwhile, but at the end of the day she was not studying, she was not doing a mandatory stint as part of a course of study. She chose to stay in the UK to become a well rounded attorney, again this is very commendable, but unfortunately that doesn't exempt her from abiding by our constitution. Tara, accept it, XXXX. Do the right thing and run again in four years.

    Tara – either you were a student or you weren't.  Either you do have a US passport or you don't.  Two very easy questions to answer and prove so just answer them, show us the proof and this can be sorted by tomorrow.  Or, admit that you messed up, save yourself embarrassment and step down if you are not eligible, and it will still be sorted by tomorrow.  

    Either way, this should not have to go through the courts which is a waste of time and money.

    Do the right thing Tara…..please.  The right thing is not to fight something that doesn't need to be fought.

    This shouldn't even need to go through the courts.  If Tara is telling the truth, then all she needs to do is to provide all the supporting documentation to prove her student status while in the UK.  With regard to the passport issue, that should be very easy to confirm.  And if it isn't, she can file an affidavit confirming that she does not have a US passport.  

    This should NOT have to go through court.  Tara can save the country a lot of money by simply providing this documentation for us.  She doesn't need to fight anything.  She just needs to provide the documents. 

    I susoect that the fact that she hasn't provided the documents means that they don't exist and that she is indeed inelgible.  I hope this is not the case but if it isn't, why is she choosing to fight rather than save us all time and money by providing the proof?  

    This does not look good.

      No. This does need to go to court here to settle the issue of whether or not mere possesion of a U.S travel document by a person who holds a birthright claim to American citizenship is legally valid constitutionally mandated grounds for disqualification. Thus far all I see is conjecture based on very faulty layman's interpretation of the relevant provisions of the constitution. I have not been witness to one single person, including the elections officers, citing any legal precedents relevant to the issue. The poorly framed and imprecise wording of the constitution is certainly contributory to the problem.

    West Bayers, if Tara is at fault and the courts finds McKeeva guilty too, there will be 2 seats up for grab in West Bay.  The best person for education that is available would be Rolston Anglin and the other candidate to replace McKeeva should be Woody DaCosta. Just Saying!

          If you let Tara run, why not let others run who also fail the Caymanian test set out in the constitution?  I don't see an exemption for people who are clever or worthy,and committed to Cayman – plenty of those around, but their participation is not welcome.  Ask yourself why the electoral law sets the limits it does – it sure as hell isnt about ensuring the best qualified candidates.

    Well it looks like Ms Rivers has already gotten her first taste of what it mean to be a politician and a constant target for your opposition and this will surely not be her last taste of it. She does seem a little green around the edges when it comes to the political battlefield in Cayman but I am sure that will eventually turn into a hardened exterior as she has to deal with this more and more realizing how quickly people will turn on you and point the finger at you.

     

    To me this suit just seems to be a last minute ditch effort from a disgruntled person  who wants the job and didn’t get it fairly. I’d think these questions should have been asked before the election. Hopefully for Ms Rivers there is no validity to the allegations, on the other hand if there are she should have known this would happen and most likely brought in on herself.

     

    If indeed the suit pushes her out no one should get in by default, there should be a by-election to insure the person that wins is selected by a majority vote

     

    Politics is a game of Hard Ball and you have to know how to play this game well to be successful.

      I think the issue really is, was she a student.  She can provide her student ID card, her tax status forms or any number of documents that can put this to bed immediately.  I hold a full time job but am studying towards a professional qualification, but that doesn't make me a student.  I hope I'm wrong but I susect Tara may be in a bit of trouble here.

    Many people engage in some form of studies while working. I think the question is… Was she spending most of her time working or studying?

      A mandatory legal internship sometimes up to 2 years is a lot of work for a small amount of money in England. It is part of the educational requirement to become a lawyer. So was it part of her studies? Yes. Was she also working? Yes. She had no choice in the matter if she wanted to be called to the Bar in England.

      No the question is what does the constitution say.  Does it disallow part time studies?   This is what the courts will have to decide.  WE have to be carful as we say we have the simple answers.  Read the Consitiution.  It does not mention how much one must study vs work.  The court will have the final say.   They will rule on what it says not what we would like it to say.

      Then when all is done on this case with the outcome on way or the other.  I feel we need to look closly at the constitution in this regard and make the needed changes.

    Caymanians can only thank themselves for this situation by allowing and condoning the constant gerrymandering of the Consitution, the immigration and election laws over the years to prevent "foreigners" from voting & especially running for election.  It's now come back to bitethem in the a**.

    Who would you rather have governing the Islands, a big fish in the small Cayman pond who has never or rarely lived abroad or someone who has studied and/or worked abroad and thereby gained a greater world knowledge to apply back here.

    The qualifications for political candidates needs to be drastically overhauled, as the current situation with Ms. Rivers proves.

        Why must that person be from the UK? That's a very stereotypical statement you made. You need to think a little bit more broader of what the outcome could be. If Tara is truly not eligible to run for politics but WINS this court battle, then a new precedent is set and it WILL open up foreigners to run for elections here. Even the Constitution can be flawed. So stop your backward thinking and think about what other consequences there could be; either a by-election or she gets to keep herseat.

          Maybe, YOU should stop the backward thinking.. if she wins this case, while not truly being eligible, then you are stating that our courts are incompetent to rule wisely on the matter. Maybe you should think about a logical response before actually typing something.

          regarding my post about persons being from the UK, it is my opninion based on many different post by UK nationals about how we caymanians are, on this site and many others. If you dont like it , tough. Last time I check , we still have free speech. You people love to say that we are backwards thinkers when we speak out..  you hate when we people dont drink your cool aide like the good little slaves we are.

      We want qualified honest caymanians running this country, not some rejected expat who feels cayman owes them something. If it was up to many of you brits, we would be slaves in our own country. Just reading your statement proves that many of you who come here think all caymanians are incompetent. You believe you can take what we have built for generations and push us in the street.       Tara is the only person who can actually set this straight, so stop blaming everybody else. All she has to do is show the evidence that she was schooling in the UK while she was working as an Associate at that UK firm.

      Where is  all the transparency, integriy and honesty that you preached about during the hustings?  Prove yourself and walk the talk! Put your money where your mouth is Tara.

      Where's the beef Tara? Show us the proof that you were schooling and all this will go away. By your very silence, it shows that all is not as it should be. Sad, and I had such great hope for you.

        OMG why don't you stop posting your "schooling" errors here!  The fact is, Velma's husband brought a suit against Tara which Tara must now answer to in a Court of Law. It is not a matter that she can just stand up on the corner and shout her innocence as you suggest. She mus answer this matter in the Courts where it was questioned. I wish Tara all the best and hope that this can quickly be resolved and that she will come out the victor.

        I think Tara very eloquently explained in her response on Friday, she is unable to give out thesedetails at this time as the case is now unfortunately before the courts. In my opinion the correct & honorable way to have handled this situation, would have been for the Hewitt's to have asked Tara publicaly to produce those documents before they took the matter to court.    At this juncture all Tara can do is to produce all of the necessary documentation that she has to the courts as directed by them. Otherwise anything that she says or does outside of the case it will be deemed prejudicial to her & the outcome of it.
